The site is a retail unit within the inner courtyard in Callow's Yard, accessed through the public entrance to the shopping area between 17 and 19, Malew Street. The unit is 11 m by 6.5 m in area and with an access off the corridor which leads from Malew Street into the central open area. To the south is a dwelling.
The site lies within an area of Mixed Use on the Castletown Local Plan of 1991 and the draft Southern Area Plan which was published on 23rd October, 2009.
In the latter document, it is acknowledged that office use can be located on the ground floor of a building where it would present an interesting frontage and would not detract from the overall character and setting of the area." (paragraph 5.6.3).
The courtyard has been the subject of a number of applications. Most recently, this unit and the first and second floors above it were the subject of an application for change of use from a cafe to either all offices or all shops - PA 10/0334.
Proposed is the additional use of the ground floor unit as a betting office. This follows an unsuccessful application for a similar change of use from an estate agent's to a betting office at 4, Arbory Street (PA 10/00932/C) which was refused because the use would have resulted in an uninteresting frontage within a prime part of the town centre. That decision was not pursued in favour of the submission of an application for this unit, which does not have any frontage onto the main public shopping streets.
Castletown Commissioners and the Highways and Traffic Division indicate that they do not oppose the application.
Castletown Heritage indicate that they do not oppose the application but seek assurance that the use will not be relocated elsewhere within Callow's Yard.
The proposed use falls within the financial office use of the Use Classes Order 2005 - uses which may not fit happily into a prime shopping street or office area due to the nature of the window display and general use, and also the need to be located close to concentrations of people, preferably shoppers, for their custom. This location is not on the main shopping street so has limited impact for those concerned with the effects of gambling (which is not a material planning concern) and the lack of an interesting shop frontage is also of less concern as effectively two of the shop frontages are within the shopping complex.
Other betting shops can be found in and around shopping areas - Douglas Street in Peel, Castle Street and Ridgeway Street in Douglas, Church Road in Port Erin. The proposed site has the benefit of not being so prominent and as such is considered to be acceptable. Any relocation to a unit with a frontage onto Malew or Arbory Street would require planning permission.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
Castletown Heritage is not directly affected by the development and as such should not be afforded party status in this instance.
