The application site is the curtilage of Ballaughton Manor Park, Ballaughton Nurseries, Douglas. The existing park is situated to the South of Ballaughton Nurseries and to the West of Harcroft Terrace.
Proposed is the creation of a playground with a secure fenced area of approximately 17.5m x 14.5m. Adjacent to this area would be a steel cableway. Also proposed is the creation of two new pathways to access the playground. Within the secure fencing there would be a number of children's play apparatus including swings, climbing frames, slides and a number of other pieces of play equipment. The highest piece of equipment would be the steel cableway which would be approximately 3.9m in height which would be sited the furthest from the residential estate.
The following previous planning application is considered specifically material in the assessment of the current application: PA 03/01420/B Creation of a public open space, bicycle funtrack and footpaths together with associated lighting and boundary fencing The above application was permitted.
The application site is within an area zoned as "Area of Open Space or Woodland (Nursery Garden)" identified on the Douglas Local Plan 1998.

The application site is to the South of the existing nurseries, and to the West of the existing residential estate. The site is within an area zoned as "Open Space or Woodland" identified on the Douglas Local Plan 1998. Whether the space is used as formal or informal space is a matter for the local authority that is responsible for the maintenance of the open space and how it is used. As many of the properties within the adjacent residential estate would be suitable for the occupation by families, the provision of formal play facilities such as are proposed here would appear to be appropriate.
The play ground would be accessed from the existing pathway within the site; two new pathways would be created which would adjoin the existing. There would be two entrance gates which would be installed as part of the new boundary fencing.
The playground area would measure approximately with a steel cableway adjacent to the play ground area which would measure approximately 22.4 m in length.
The proposed playground would be in close proximity of surrounding residential estates, but would be sufficient distance to prevent overlooking, loss of privacy, noise and disturbance. The closest piece of play apparatus would be approximately 45 m from the nearest property, there is also mature planting on the boundary, a mixture of hedging and trees this would provide substantial screening of the proposed play ground.
Due to the distance of the proposed playground from the residential properties, the height and orientation of the play apparatus, it is considered that the proposed development would not result in any significant adverse impacts upon the residential amenities of the neighbouring properties.
For the above reasons the application is considered to be acceptable and is recommended for approval.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 2. This permission relates to the creation of a playground shown in drawings BE15/10/020/1001, , BE15/10/020/1002, 3/83615 and Equipment detail received 2nd September 2010.
