Environment Policy 42

Approved plans
This approval relates to the demolition of existing building and erection of an apartment block to provide seven residential and seven tourist apartments with associated parking as proposed in the submitted documents and drawings 8033 P10, 8033 L01, 8033 L02, 8033 L03, 8033 L04, 8033 L05, 8033 P05C, 8033 P0613, 8033 P0713, 8033 P08C, 8033 P09A, 8033 P10 and 8033 P11 B all received on 20th November 2012, 6th December 2012 and 21st December 2012.
Unit use restrictions
No more than seven units will be used for permanent residential purposes, and no more than seven units will be used for tourist purposes. Once a unit has been used for permanent residential purposes or tourist purposes (as defined below) that shall be considered its lawful use unless planning permission for an alternative use is granted. The owner/operator shall notify the Planning Authority upon first occupation of the use of each unit.
Tourist definition
Tourism has been defined by the Tourism Society as "the temporary short term movement of people to destinations outside the places where they normally live and work and their activities during their stay at these destinations" and it covers a very wide range of activities and types of development. This may include travel and visits for business, professional and domestic purposes as well as for holidays and recreation.
Tourist register
The owner/operator shall maintain an up to date register of the names of all occupiers of the tourist units on the site and of their main home addresses and shall make this information available at all reasonable times to the Planning Authority.
Parking availability
Prior to the occupation of any of the residential apartments or tourist apartments all the basement parking and undercroft parking must be available for use only by those occupying the apartments hereby approved.
Tourist letting restrictions
The tourist units shall be used only by tourists with no individual tenancy exceeding 4 weeks in duration between Easter and October 1st, outside of these months longer lets may be permitted.
