The application site is No. 2 Southview, Queens Promenade. The application is the Douglas Promenades Conservation Area. The site is currently a pizza takeaway/restaurant.
The application is seeking a retrospective consent to display illuminated and non-illuminated signage on the side elevation of the building.

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, General Policy 6, Environment Policy 35 and 37
General Policy 6 states that "Within our town and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
Environment Policy 35 states that "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the area, and will ensure that he special features contributing to the character and quality are protected against inappropriate development."
Environment Policy 37 states that "As a general policy, advertisements within Conservation Areas will be permitted only if: i) the proposal preserve or enhances the Conservation Area; ii) the signage is in a style appropriate to the character of the area; iii) traditional materials and finishes are used and glossy and highly reflective materials are excluded from proposals; and iv) internally illuminated box fascia and projecting box signs are excluded from the proposals.
Section 18 (4) of the Town and Country Planning Act 1999 states that "Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing it character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act."
There have been previous applications on the site; however, none are considered relevant in the consideration of this application:
Highways Division of the Department of Infrastructure do not oppose has the application has no traffic management, parking or road safety implications.
Douglas Corporation have no objection to the application.
The principal issues in assessing this application are a) whether the advertisement impact on the amenity of the area and b) public safety.
In terms of amenity, General Policy 6 and Environment Policy 37 must be considered to assess whether the advertisements accord with these policies. General Policy 6 states that "Within our town and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
In terms of the design of the advertisement, Environment Policy 37 sets out what is considered to be acceptable for a Conservation Area. The policy states that "As a general policy, advertisements within Conservation Areas will be permitted only if: i) the proposal preserve or enhances the Conservation Area; ii) the signage is in a style appropriate to the character of the area; iii) traditional materials and finishes are used and glossy and highly reflective materials are excluded from proposals; and iv) internally illuminated box fascia and projecting box signs are excluded from the proposals.
The advertisements are plastic advertisements attached to the side of the building. One of which a illuminated light box. The choice of materials is certainly not of a high design standard and is not of traditional materials/finishes. The advertisements do not preserve or enhance the character and appearance of the Conservation Area. The advertisements are additional clutter into the streetscene. It is considered the continued display of advertisement on a permanent nature would impact on the visual amenities of the locality.
In terms of public safety, the Highways Division do not oppose the application as it has no traffic management, parking or road safety implications.
It is recommended that the application be refused for the above reasons.
The local authority is, by virtue of The Control of Advertisement Regulations 2005. Town and Country Planning (Development Procedure) Order 2005, Regulation 9 (5) (5) (c), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

The continued display of the advertisements would be contrary to General Policy 2, General Policy 6, and Environment Policy 37 of the Isle of Man Strategic Plan 2007 by reason of their siting, design, materials and location which results in the introduction of additional clutter into the street scene, and is of serious detriment of the visual amenities of the locality.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Senior Planning Officer.
