Dear Sir/Madam ON APPEAL: PA 10/01123/C - Heritage Homes Ltd - Removal of condition 7 and variation of condition 9 of the approval granted in respect of PA 09/00521/B; and PA 10/01124/B - Heritage Homes Ltd - Amendment of drainage arrangements approved under PA 09/00521/B
Residential development of 43 dwellings under construction, parts of fields 315097, 311825 & 311826 adjoining Reayrt Ny Keylley, to the South of Derby Road/ Poortown Road, Peel (appeal by Mr T & Mrs A Cowin)
I refer to the recent appeals in respect of the above planning applications, and enclose a copy of the report of the person appointed to consider these appeals.
The Minister has considered the report, and is minded to accept the appointed person's recommendations. Accordingly, and as suggested in paragraph 37(ii) of the report, the Minister now - (a) gives the applicant, Heritage Homes Ltd, an opportunity to enter into an agreement with the Department under section 13 of the Town and Country Planning Act 1999 relating to the provision of 11 Affordable Houses; (b) seeks from the applicant written confirmation of which approval is being implemented; and (c) in relation to the amendment of condition 9 of the approval granted in respect of PA 09/00521/B, seeks comment on the wording recommended by the appointed person; it appears to the Minister that this wording is not entirely clear, and that it should refer to the removal of the on-site treatment plant once it becomes redundant as a result of the public sewerage system in Peel being connected to a system such as "IRIS" which includes sewage treatment. cont/...
Responses hereto should be received by the Department by 21st April 2011, after which the Minister will consider the responses, give further consideration to the report, and determine the appeals.
