ON APPEAL: 10/917/B - Colby AFC Ltd - Amended lighting scheme for approved access road and car park areas proposed football ground, Field 424828, 424827, 424826, 424573, access road via 424845, 424824, Station Road, Colby (Appeal by P J Cringle)

I refer to the recent appeal in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.

I am directed to advise you that Mr D Callister MLC, who has been appointed to act as Deputy to the Minister for Infrastructure in relation to planning appeals in the Minister's absence, has considered the report, and concurs with the appointed person's conclusions and accepts the recommendation that the appeal should be allowed. Accordingly, he has directed that the Planning Committee's decision to approve the application should be reversed, and that the application should be refused for the reasons referred to in paragraphs 21 and 23 of the report. Formal notice of this decision is attached.

The Deputy Minister indicated that his decision is without prejudice to a further application which: (a) in respect of the access road, proposes bollard lighting; and (b) in respect of the car-park, proposes a lower level of illumination and includes examination of the use of bollard lighting.

THE TOWN AND COUNTRY PLANNING (DEVELOPMENT PROCEDURE) ORDER 2005

TO: Colby AFC Ltd, K S Skinner (Chairman), 3 Vicarage Close, Ballabeg, Arbory [Copies as per Circulation List]

In pursuance of his powers under the above Act and Order, the DEPUTY MINISTER for Infrastructure, following report by the appointed person, does hereby REFUSE the application by Colby AFC Ltd - Amended lighting scheme for approved access road and car park areas proposed football ground, Field 424828, 424827, 424826, 424573, access road via 424845, 424824, Station Road, Colby for the following reasons:-

1. In respect of the access road, the proposed lamp standards would be an intrusive feature in the landscape which would have an unacceptable impact on the rural character of the area.
2. In respect of the car-park, the proposed level of illumination would be excessive and intrusive, and would unnecessarily harm amenity; the lamp columns would constitute a further, unnecessary urbanising influence.
