The application site represents the curtilage of the converted Barn, at Robin Hill Farm, Cronk-yDhooney, Ballakilpheric. The existing site comprises of the farmhouse, the converted Barn and a number of outbuildings.
Proposed is the installation of replacement windows and doors. The existing windows and doors are timber, the replacement windows and doors would be uPVC casement style windows.
The following previous application is considered specifically material in the assessment of the application:
PA 09/01500/B Conversion of existing disused barn into two holiday units The above application was permitted.
The application site is within an area zoned as "Open Space" identified on the Arbory and East Rushen Local Plan 1998. The converted Barn is currently used for tourist accommodation.
Rushen Commissioners have not commented.
Highways Division have not commented.
Given the nature of the proposed development it is appropriate to consider 1/98 which refers to the alteration and replacement of windows:
"An individual building, or group of buildings, whose principle elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable or the existing windows are not the originals, the preference will be for replacement windows on the said principle elevations, to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows."
The proposed replacement windows and doors would have the same method of opening as the existing windows. The property is not highly visible from the public thoroughfare, so it would not have a harmful impact on the visual amenity of local residents.
The proposed windows would have the same method of opening as those that have been given permission previously, the use of material would be different from what was approved, but given that the proposed development would not be seen from a public thoroughfare, it is considered that there would be very minimal impact to the amenity of local residents.
Given that the windows would be the same method of opening as the ones approved, it is considered that the proposed windows would not be detrimental to the appearance and character of the property and the surrounding area in general.
For the above reasons the application is considered acceptable, and is recommended for approval.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
