Planning Status And Relevant Policies
Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, paragraph 8.12.1, Environment Policy 35
Assessment
The application site is within a Conservation Area. It should be noted that an application was granted in 2003 for erection of a double garage with terrace over the rear of the property. This application is similar in boundary treatment around the roof terrace as previously approved. The proposal is set to the rear of the property and will not be visible from Derby Square. The proposal will not adversely affect the character and appearance of the conservation area.
Recommendation
It is recommended that the planning permission be granted subject to conditions in the attached schedule.
Party Status
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
