The application site comprises the residential curtilage of Ballalough House, Smeale Road, Andreas, which is a large single-storey detached bungalow, located on the western side of the Smeale Road and north of Andreas Village.
The application site is within an area recognised as being an area of 'white land' not zoned for development, under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area, nor within an area zoned as High Landscape or Coastal Value and Scenic Significance.
Due to the proposal and zoning of the land the following policy is required to be considered:
Policy 13: Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents.
The application site has been the subject of a number of previous planning applications:
Conversion of detached garage to living accommodation with link extension - 06/01559/B APPROVED
Alterations and extensions to rear of dwelling and erection of external staircase to over garage store 03/00599/B - APPROVED
Conversion of existing garage into living accommodation - 96/00887/B - APPROVED Alterations to dwelling and re-location of LPG tanks 94/00672/B - SPLIT DECISION
The application seeks approval for the additional use of the residential dwelling for tourist accommodation.
Andreas Parish Commissioners:- "No objections." Highways Division do not oppose:- "Has no traffic management, parking or road safety implications. Note: Outstanding visibility splay work needs to be carried out before this proposal can be used as tourist accommodation PA 06/01559/B refers."
The Authority has received no privately written representations objecting to the application.
The large dwelling is set with substantial grounds and located 34 metres from the nearest neighbouring property Thie Sollysh (substantial landscaping between the two properties). The dwelling has a sizeable driveway which can provide the required parking requirements.
Overall, it is considered given the size of the dwelling/site and the position of the dwelling in relation to neighbouring properties, it is considered the use of the dwelling for tourist accommodation would be acceptable, and have no adverse impacts upon residential amenities of nearby properties.
It is considered that the proposal would comply with The Isle of Man Strategic Plan (20th June 2007), for the reasons set out in this report, accordingly, it is recommended that the application be approved.
It is considered that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Andreas Parish Commissioners The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
Recommended Decision: Permitted
C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the additional use of residential dwelling for tourist accommodation as proposed in the submitted documents and drawings BH-10-01A and BH-10-02A all received on 19th April 2010.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
