Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
Miss P Newton 2 Glen View South Cape Laxey
In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:
Name: Mr Gary Walker Proposal: Erection of a kennel block at: Melrose Cottage St Judes Road Andreas Isle Of Man IM7 3HF
which was considered on 19th August 2010, for the reasons set out below.
Date of Issue: 20th August 2010
Murray House Mount Havelock Douglas
Reason(S) For Refusal:
- The level of noise generated from the accommodation of dogs on site through the proposed ten kennels, would result in an unacceptable impact upon the residential amenities of the nearby properties contrary to Environmental Policy 22 of the Isle of Man Strategic Plan.
- The visibility from the access driveway onto the A17 is inadequate to serve the needs of the development and therefore would be prejudicial to highway safety.
This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
