THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a dwelling that is located on Ramsey Road in Laxey. The proposed development comprises the installation of replacement windows within the dwelling. PLANNING HISTORY
The application site has not been the subject of any previous planning applications that are considered specifically material to the assessment of this current planning application.
REPRESENTATIONS Laxey Village Commissioners recommend that the planning application be approved. PLANNING POLICY
In terms of local plan policy, the application site is within an area recognised as being within predominantly residential use under the Laxey and Lonan Area Plan Order 2005. Policy L/RES/PR/1 states:
"Residential development will generally only be approved within the study area in those areas designated as proposed and existing residential. In particular, in the case of Agneash no further dwellings will be approved although, as will be the case in areas zoned as residential, alterations and extensions to existing property may be accepted if such proposals are sympathetic to the character and appearance of both the building to be altered and the surrounding area in general."
In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application. General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Planning Circular 1/98 sets out the Department's policy for of the alteration and replacement of windows. In respect of buildings outside of Conservation Areas it states:
"In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encourage by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows.
Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction."
The planning application seeks approval for the installation of replacement windows within the dwelling. The proposed windows are uPVC and replicate the existing windows.
As the windows replicate the existing windows it is considered that the proposal accords with the provisions of Planning Circular 1/98 and is acceptable.
It is recommended that the planning application be approved.
