Officer's Report
The Site
The application site is the curtilage of 44 Bray Hill, Douglas. The existing property is a two storey end of terrace situated to the north eastern side of Malvern Road.
The Proposal
The application seeks approval for the installation of replacement windows in the front and side elevations. The windows would be replaced with white uPVC casements. The ground floor replacement windows would be uPVC, which would have decorative glass to top lights, to match the existing ground floor windows.
Planning History
The previous planning applications are not considered specifically material in the assessment of the current application.
Development Plan Policies
The application site is within an area zoned as "Predominantly Residential" identified on the Douglas Local Plan 1998. It is appropriate to consider Planning Circular 1/98 in the assessment of the current application.

Assessment
Given the nature of the application it is appropriate to consider Planning Circular 1/98, which states:
"In an individual building, or group of buildings, whose principle elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows.
Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction."
The application seeks approval for the installation of replacement windows in the front and side elevations. The replacement windows would be white u PVC casements which would have similar glazing sections as the originals; the windows in the ground floor front would have decorative glass in the top lights, similar to the originals.
It is considered that the proposed replacement windows would not be detrimental to the character and appearance of the property and for the above reasons the application is recommended for approval.
Party Status
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the installation of replacement windows as shown in drawings 10/80/01 and 10/80/02 received 5th January 2011.
