1.1 The site is the farmyard of Ballakilley Farm, a holding of around 160 acres which lie to the west of Maughold Village and to the south of the A15 as it approaches Maughold village from Port Lewaigue and to the west of it as it heads south from the village towards Ballajora. The site also crosses the A15 and extends out as far as Port Mooar.
1.2 In the centre of the site is the farmyard, accessed via a farm lane from the A15 is a group of buildings including a farmhouse and attached barn, two further agricultural buildings lies to the north east of the farmhouse and another lies to the west attached to which is a single storey workshop formed from a mono-pitch roofed rendered structure with a recently demolished brick storage building alongside.
2.1 Proposed is the erection of a new building in place of the recently demolished brick building. The new building will be 1.5m longer than that which previously existed on the site and of modern, sheeted finish in an olive green colour typical of many rural buildings. The building will have dimensions of 9.3m by 19m and a roof whose pitch is just over 5m high.
3.1 The site lies within an area of High Landscape Value and Scenic Significance on the Isle of Man Planning Scheme (Development Plan) Order 1982. As such, whilst there is a presumption against development as set out in Environment Policies 1 and 2, there is also provision, included within General Policy 3 and Environment Policy 15 for the erection of agriculturally justified buildings.
"Development will not be permitted outside of those areas which are zoned for development on the appropriate Area Plan with the exception of:
f) building and engineering operations which are essential for the conduct of agriculture or forestry."
Environment Policy 15 states "Where the Department is satisfied that there is agricultural or horticultural need for a new building (including a dwelling), sufficient to outweigh the general policy against development in the countryside, and that the impact of this development including buildings, accesses, servicing etc. is acceptable, such development must be sited as

close as is practically possible to existing building groups and be appropriate in terms of scale, materials, colour, siting and form to ensure that all new developments are sympathetic to the landscape and built environment of which they form a part.
Only in exceptional circumstances will buildings be permitted in exposed or isolated areas or close to public highways and in all such cases will be subject to appropriate landscaping. The nature and materials of construction must also be appropriate to the purposes for which is it intended.
Where new agricultural buildings are proposed next to or close to existing residential properties care must be taken to ensure that there is no unacceptable adverse impact through any activity, although it must be borne in mind that many farming activities require buildings which are best sited, in landscape terms, close to existing building groups in the rural landscape."
4.1 Planning approval was granted for a replacement barn under PA 13/91136/B. This relates to the buildings to the east of the farmhouse.
5.1 There are no representations on file at the time of writing.
6.1 The proposal will result in a building which is similar in size and finish to others in the group, which are being improved and replaced. The farm is established and the proposed building appropriate to its purpose. As there was a building there previously, it is not considered inappropriate for a building to be erected here, within the existing farm group and using the main farm access and it is considered to comply with the guidance contained within EP 15.
6.2 As such the application is recommended for approval.
7.1 The local authority is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered "interested persons" and as such should be afforded party status.
7.2 Department of Infrastructure Highway Services is granted interested party status under the Town and Country Planning (Development Procedure) (No 2) Order 2013 paragraph 6 (4) d.

C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
C 2. The building must be used only for agricultural purposes.
REASON: the countryside is protected from development and an exception is being made on the basis of agricultural need. As such the building must be used for the purposes for which it is approved.
This approval relates to drawings SM14/354/1, SM14/354/2 and SM14/354/3 all received on 27th November, 2014..
