Environment Policy 1

Protects countryside for its own sake, permitting development only with overriding national need and no alternative. Officer noted the site is countryside but the application is not new development; removal tested whether original agricultural justification still holds, finding ongoing need to retain restriction to support exceptional countryside permissions.

General Policy 3

Restricts development outside zoned areas except essential agricultural workers' housing (a). Officer assessed that the original dwelling was approved under this exception, so removal requires evidence that long-term agricultural need no longer exists; found land still farmed, so exception rationale persists.

Housing Policy 8

Requires agricultural occupancy condition on approved farm dwellings. Officer applied this to justify retaining C12, as it enforces the policy restriction on occupants engaged or last engaged solely in agriculture or dependants.

Paragraph 8.9.4 of The Isle of Man Strategic Plan

States agricultural conditions not usually removed unless long-term need for such dwellings on the farm/locality no longer warrants reservation. Central test applied by officer: applicant failed to show no ongoing need despite family farm cessation in 1999, as local land remains farmed.
