1- k Isle of Man Government H n I ( V £■; ( j rr V j r ir r r Dave Luton Design Engine House Studio Agneash Lonan Isle of Man IM4 7NS Town and Country Planning Act 1999 The Town and Country Planning (Development Procedure) (No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to REFUSE a planning application by Mrs Meg Cowin, Ref 14/00349/B, for the replacement of Public House with four detached dwellings with associated parking at The New Inn New Road Laxey Isle of Man IM4 7HS for the following reason(5);

1. Tlie proposal would result in an increase in the number of access points onto New Road, which is a secondary road and as such would have an adverse impact on road safety and interrupt the free flow of traffic.
2. The proposal fails to take account of pedestrian safety with a lack of any footpaths or a pedestrian refuge contrary to Transport Policy 6 of the Strategic Plan.
3. While the Planning Committee had no objection to the design of the retaining wall, they considered that insufficient information has been provided for them to be satisfied that the proposed bank stability measures are achievable and if not what the resulting visual impact would be. As such the proposal would be contrary to Environment Policies 28 and 36 and Strategic Policy 5. The Committee consider that an engineering report should be a pre-requisite of any approval. Any appeal against this decision must be in accordance with Article 8 of the Order. A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
