Isle of Man Government f?r»ny< V t r Mr Robert Nelson 18 Kensington Road Douglas Isle Of Man IMl SEP Town and Country Planning Act 1999 The Town and Country Planning (Development Procedure) (No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to REFUSE a planning application by Mr Robert Nelson, Ref 14/00683/B, for the Removal of a chimney stack at 18 Kensington Road Douglas Isle Of Man IMl SEP for the following reason(s}; The proposed removal of the chimney would result in the loss of an important architectural feature that forms an important part of the design and character of the terrace. The removal of the chimney would have a detrimental impact on the character and appearance of the dwelling and the wider terrace. It would also make it more difficult to resist applications for the removal of further chimneys in the terrace, thus diluting the architectural character and appearance of the terrace yet further. The proposal would be harmful to the character and appearance of the Conservation Area and flails to accord with General Policy 2 and Environmental Policy 35 of the Isle of Man Strategic Plan 2007, as well as Policy CA/2 of Planning Policy Statement 1/01 "Conservation of the Historic Environment". 1. Date of Issue: 17th July 2014 /H Director of Planning and Building Control Guidance Note This decision was made by a Senior Pianning Officer in accordance with the authority delegated to them. A copy of the Officer's report which led to the decision is enclosed. Any appeal against this decision must be in accordance with Article 8 of the Order. A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice.

To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
