The Town and Country Planning (Development Procedure) Order 2005

In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Mrs Mary Quayle, Ref 13/00385/A, for the approval in principle for erection of two dwellings with new vehicular access at land adjacent to Ballacraine Cottages Ballacraine St Johns Isle of Man subject to compliance with the following condition(s):

1. The development hereby approved shall be begun either before the expiration of four years from the date of this approval or before the expiration of two years from the date of approval of the last of the reserved matters.

Reason: To comply with article 13 of the Town and Country Planning (Development Procedure) Order 2005.

1. Application for approval of the reserved matters shall be made to the Planning Authority before the expiration of two years from the date of this approval and thereafter the development shall only be carried out in accordance with the details as approved.

Reason: To avoid the accumulation of unimplemented planning approvals.

1. The Reserved Matters application requires taking into account of the mature trees along the southern boundary of Plot 1 and any scheme should be designed to ensure the retention of such trees both during construction and thereafter. The applicants are highly recommended to discuss this matter with the Department of Environment, Food and Agriculture - Forestry, Amenity and Lands Directorate prior to submitting any Reserved Matters application.

Reason: To safeguard the appearance of the development and the surrounding area.

1. The Reserved Matters application requires a plan to be provided which shows a site compound which includes storage areas and vehicle parking (deliveries, tradesmen etc) to ensure there are adequate provisions on site to prevent on street parking.

Reason: In the interests of highway safety.

NOTE This permission does not infer approval or acceptance of the details of the illustrative drawings submitted as part of this application.

Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

No development may be undertaken until such time as the relevant reserved matters have been approved by the Planning Authority.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
