J- . i Isle of Man Government ^ei I f y » E 11 j tt Vj f\ IIIr Dave Luton Design Engine House Studio Agneash Lonan Isle Of Man IM4 7NS Town and Country Planning Act 1999 The Town and Country Planning (Development Procedure) (No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to REFUSE a planning application by Mr William Reubens, Ref 14/00761/B, for the Erection of a dwelling with driveway and parking at Alder Oaks Field 431505 St Marks Road St Marks Ballasalla Isle Of Man for the following reason(s): Whilst the Department has considerable sympathy with the applicant’s circumstances, it is not considered that the policies which protect the countryside from development, as set out in Environment Policy 1 of the Strategic Plan should be set aside. The site is not designated for development nor within a sustainable location and as such the development would be contrary to the Strategic Aim, Strategic Policies Ic, 2 and 10, Spatial Policy 5, General Policy 3, Environment Policy 1 and Housing Policy 4 of the Strategic Plan. 1. 2. Whilst the dwelling has been designed to be low level and as unobtrusive as possible, the creation of the access would result in a visual impact in itself which would be managed and domestic in appearance due to the need to maintain the height of the hedge lower than it is presently. A copy of the Officer's report which led to the decision is enclosed. Any appeal against this decision must be in accordance with Article 8 of the Order.

A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
