Isle of Man Government Rr I i l y i E i i J 'f j r ft I r Mr Derek Cadamy 20 Milner Close Port Erin IM9 6BG Town and Country Planning Act 1999 The Town and Country Planning (Development Procedure) (No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to REFUSE a planning application by Mr Derek Cadamy, Ref 14/00546/B, for the Removal of condition 3 of PA 09/00979/B for the raising / lowering and use of flood lighting at Bowling Green Breagle Glen Saint Marys Road Port Erin Isle Of Man IM9 6J3 for the following reason(s}; The lighting was approved subject to there being in place conditions regarding the illumination of the lights and the erection of the lighting poles in order to protect the amenities of those living closest thereto. It is not considered that there has been any change in circumstances to warrant reducing the level of control and to do so would result in an adverse impact on the living conditions of those close to the site. 1. Date of Issue: 24th June 2014 Director of Planning and Building Control Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it. A copy of the Officer's report which led to the decision is enclosed. Any appeal against this decision must be in accordance with Article 8 of the Order. A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
