The original application (14/00605/A) for approval in principle for two semi-detached dwellings on land adjacent to Field 131049, Vollan Crescent, Ramsey was refused due to conflict with Local Plan zoning as Areas of Open Space/Woodland (POS) and loss of public amenity. The appellant argued the POS zoning was erroneous based on historical deeds, prior residential use, and policy compliance including as previously developed land and infill, citing precedents and infrastructure availability. The Council defended the refusal citing Strategic Plan policies on zoning, POS protection, and visual character. The inspector found the site not zoned for development, not qualifying as previously developed land per General Policy 3 exceptions, not infill, and causing substantial harm to character and visual amenity from the seafront, recommending dismissal.
