PLANNING OFFICER REPORT AND RECOMMENDATIONS Application No. : Applicant: Proposal: Site Address: 14/00391/B Parkhouse Developments Limited Removal of two chimney stacks Seamount Bay View Road Port St. Mary Isle Of Man IM9 SAG Case Officer: Photo Taken : Site Visit: Expected Decision Level: Officer Delegation Miss Laura Davy Officer's Report 1.0 THE SITE 1.1 The application site is the curtilage of Seamount, Bay View Road, Port St Mary which is a large building situated on the corner of Bay View Road and Ceilings Avenue. It is a three storey property in a prominent location. It is a red brick building with a shop front facing on to Bay View Road. 1.2 The building has a turret on the corner of the building which adds an interesting feature to the corner of the property, Ttiere are also two substantial chimney stacks which can be viewed from Ceilings Avenue and Bay View Road. 2.0 THE PROPOSAL 2.1 The application seeks approval for the removal of the chimney stacks and making good the roof. 3.0 PLANNING HISTORY 3.1 There was an application for replacement windows in 2009 this was PA 09/00692/B, this application was approved. 4.0 DEVELOPMENT PLAN POLICIES 4.1 The application site is within an area zoned as "Mixed Use" identified on The Area Plan for the South 2013. It is also within the Proposed Conservation Area. Given the nature of the application it is appropriate to consider General Policy 2 and Environment Policy 35 of the Isie of Man Strategic Plan (20th June 2007). 4.2 General Policy 2 Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality. 4.3 Environment Policy 35 6 May 2014 14/00391/B Page 1 of 3

Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development. 5.0 CONSULTATIONS 5.1 Port St Mary Commissioners do not object 6.0 ASSESSMENT 6.1 The application seeks approval for the removal of the chimney stacks from the roof slope and making good. The main issues to consider in the assessment of the application are the impacts upon the character and appearance of the property and the impact upon the character and appearance of the area in general. 6.2 The property is in a prominent position in the street scene and is an attractive end of terrace property. While the applicant has indicated that the chimneys are unused they are an attractive aspect within the street scene and make a positive contribution to the overall character and appearance of the terrace. The chimneys are visible from Bay View Road and Ceilings Avenue and are an important feature from both of these viewpoints. 6.3 It is considered that the removal of the chimney stacks would have a harmful impact upon the site and surroundings and would have an adverse impact upon the character of the townscape which would be contrary to General Policy 2, 6.4 Whilst the site is not within a Conservation Area it is in the proposed Conservation Area, features such as these chimney stacks form an important part of the character of the area and therefore should be retained. 6.5 It is considered that the removal of the chimney stacks would have an adverse impact upon the character and appearance of the surrounding townscape. 6.6 For the above reasons the application is considered to be unacceptable and is recommended for refusal. 7.0 PARTY STATUS 7.1 The local authority. Port St Mary Commissioners are, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered an "interested person" and as such should be afforded interested person status. The removal of the chimney stacks would have an adverse impact upon the character and appearance of the property and the locality in general which would be contrary to General Policy 2 of the Isle of Man Strategic Plan.
