Officer’s Report
1.0 Description 1.1 The proposed application 24/00397/B for the Conversion of existing garage to kennels and change of use of part field for dog exercise was approved by the Planning Committee on 14.04.2025 subject to 11 conditions, some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Conditions (2) and (10) which the applicants are seeking to satisfy.
The specific wording of the conditions are as follows:
(2) A plan clearly distinguishing the residential curtilage and the associated field shall be submitted within one month of this approval. This boundary should reflect the details outlined in Condition 3 of PA 20/01494/B: The residential curtilage shall extend no further south than the area including the "drive" and the footprints of the two existing buildings as

25/10060/AIR shown on drawing DN/2/20 and may not include the field to the south, which is defined in red on the submitted plans.
REASON: The site is not designated for development, and the expansion of the residential curtilage would represent unauthorized development in the countryside, contrary to Environment Policy 1 of the Strategic Plan
(10) A detailed waste management plan, including provisions for the disposal of dog waste, shall be submitted to and approved in writing by the Department. All waste shall be collected in designated receptacles and removed from the site regularly.
REASON: To prevent any adverse impact on the environment and nearby properties, in accordance with Environment Policy 2.
2.0 Proposal 2.1 The applicant's agent has submitted details in relation to division of the residential curtilage and waste disposal plan, along with a duly completed AIRC form on the 28.06.2025.
2.2 In relation to condition 2 - Drawing titled Proposed Residential Curtilage, numbered 004: clearly outlines the separation between the residential curtilage (red) and the adjacent field (blue)
2.4 In relation to condition 10 - The covering letter states that, all dog waste is to be picked up and put into dedicated dog waste bins which will be collected weekly and disposed of accordingly.
3.0 Consultation 3.1 Consultation was made with the Planning Officer that dealt with the original planning application. The advice received 19.06.2025, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
3.2 Consultation was made with the Department's Environmental Protection Unit and after their review of the submitted and revised documents, they have concluded that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 Recommendation 4.1 In this instance of the submitted documentation and after consultation with the relevant Department confirming that they are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning conditions 2 and 10 of application 24/00397/B, under the understanding that the development shall not be carried out unless in accordance with the approved details. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
