Tel 01624 685950 Mr Daniel Reid 10 Falcon Cliff Court Douglas IM2 4AQ TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Fraser Reid Design Limited, Ref 25/90262/B, for the Conversion of tennis courts to six padel tennis courts and erection of supporting facilities at Tennis Courts Nobles Park Douglas Isle Of Man . Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes). 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals. 2. Prior to the installation of any boundary fencing as shown on drawing 20195-PL03 a detailed drawing of the western boundary fencing of the site which is no taller than 3m in height shall be submitted to and approved in writing by the Department and these approved details shall be full adhered to and retained thereafter while the site is in operation. Reason In the interest of visual amenities of the area. 3. The courts and ancillary seating areas as shown on drawing 20195-PL03 hereby approved shall only be used between the hours of 0600hrs and 2200hrs. Reason: In the interests of the visual amenities of the area, neighbouring amenities and the times are those which have been set out in the submitted documents and have been considered on this basis only. 4. The low level lighting (bollards and wall lighting) as shown on drawing 20195-PL03 shall not be in operation between 2220hrs and 0540hrs.

The floodlighting as shown on drawing 20195-PL03 shall not be in operation between 2205hrs and 0555hrs. Prior to the installation of any glass court screening details of the bird strike prevention film shall be submitted to and approved in writing by the Department and these approved details shall be installed prior to the use of any court and retained thereafter. Reason: In the interest of bird strike prevention. This approval relates to the submitted documents and drawings all received on 10.03.2025. This decision has been made for the following reasons(s) In conclusion, while the proposed do increase the level of built form on the site, introduce a greater level of lighting to the site and have the potential to generate a greater level of people visiting the site/area; it is considered these additional impacts would not have such a significant adverse impacts upon public or private amenities to warrant a refusal. Furthermore, it is considered the proposed uses would provide a new sporting/leisure facility on the Island to the benefits of residents. Therefore for these reasons and those outlined within this report, it is considered the proposal complies with complies with General Policy 2, Strategic Policy 5, Transport Policy 7, Recreation Policy 2, Community Policy 2 & 3 and Environment Policy 36 of the IOM Strategic Plan 2016, Area Plan for the East 2020 and Our Island Plan 2025-26. Tel 01624 685950 Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it. This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation. A copy of the Officer’s report and any correspondence which informed the assessment and decision is available to view on the Government’s website (via https://pbc.gov.im/online- applications/) Implementation A determination to grant planning approval does not have effect - if an appeal is submitted until the appeal is determined or withdrawn; or if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice). Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation. Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action. Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
