Officer’s Report
1.0 Description 1.1 The proposed application 24/91155/B for the demolition of existing building and construction of 4 no. detached dwellings was approved on by the Planning Committee on 09.12.2024 subject to 10 conditions, some of which required submission of additional information prior to the commencement of works.

1.2 This report is specific to Condition 4 which the applicants are seeking to satisfy.
1.3 Specific wording of the condition is as follows:
1.4 No site clearance, preparatory work or development shall take place until a detail tree protection scheme accordance with the recommendations of Section 6.2.2 of British Standard 5837:2012 has been submitted to an approved in writing by the Department. This approved scheme shall be implemented prior to any works commencing and maintained in position until the development is complete.
In the event that trees become damaged or otherwise defective during such period, the Department shall be notified as soon as reasonably practicable and remedial action agreed and implemented. In the event that a tree dies or is wilfully removed without prior consent it shall be replaced as is reasonably practicable and, in any case, by not later than the end of the first available planting season, with trees of such size, species and in such number and positions as may be agreed with the Department.
REASON: to ensure that all trees to be retained are adequately protected from damage to health and stability throughout the construction period in the interests of amenity.
2.0 Proposal 2.1 The applicant's agent has submitted a details of the full tree protection measures and the Herras fencing details along with a duly completed application form on 20.03.2025.
2.2 The removal of 3 no trees has been recommended and approved. These trees are identified on the drawing SOH-16. 2 no. trees to the front of the site are to be retained.
Risks posed to the retained trees during the construction phase can be reduced by installing protective fencing to demarcate a Construction Exclusion Zone (CEZ). Please refer to the associated Outline Tree Protection Plan (SOH-C4-01) for details.
Based on the proposed design and the protection measures proposed (see SOH-C4-01 for details), it is unlikely that the construction of the proposed dwelling on plot 4 will result in incursions into the Root Protection Areas of two retained trees.
The Herras fencing is to be installed in accordance with the attached manufacturer's instructions.
A follow-up tree assessment should be carried out by a suitably qualified arboriculturist immediately following completion of the development in order to identify any retained trees requiring remedial works.
Cyclical 'duty of care' tree surveys, commissioned by the tree owner, will act to minimise and manage any foreseeable risks posed by the trees to the owner's property and any person owed the duty of care.
2.3 The applicant's agent has provided the full specification of the Herras Fencing with details for the installation.
2.4 Drawing No. SOH-C4-01 provides a detailed Tree Protection Plan. The construction exclusion zone has been clearly marked.
2.5 Drawing No. SOH-16A provides a detailed Tree Removal Plan.

3.0 Consultation 3.1 The Department's Forestry Team were consulted for advice on the satisfaction of condition. Mr Charles Harrison, The Department's Senior Arboriculture Manager has confirmed that "I can confirm that the documents contained in PA 25/10042/AIR satisfy condition 4 of PA 24/9155/B" on 30.04.2025.
4.0 Recommendation 4.1 In this instance of the submitted drawings and documentation, and after consultation with the case officer, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 4 of application 24/91155/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
