The officer determined that the principle of the car park conflicts with General Policy 3 as the site is unzoned countryside land and the proposal does not qualify under any exceptional circumstances …
General Policy 3
Restricts development in unzoned countryside to specific exceptions (e.g. agricultural housing, redundant building conversions, national need). Officer assessed car park does not qualify under any exception (g), lacks evidence of no alternative sites or national need, establishing unacceptable principle.
Environment Policy 1
Protects countryside ecology/character unless overriding national need with no alternative. Officer found urban car park harms landscape/ecology without justification, applied to both landscape and habitat loss.
Environment Policy 2
Prioritises landscape character protection in Areas of High Landscape Value unless no harm or essential location. Officer concluded hardstanding introduces urban form harming rural character in visually prominent site.
Environment Policy 4
Prohibits harm to nationally/locally important habitats/species (e.g. priority habitats, protected species). Site's rare marshy grassland, orchids, frogs unprotected without mitigation or overriding need.
Environment Policy 7
Protects watercourses/wetlands from harm, requires risk assessments. Proposal near River Dhoo lacks water quality/pollution measures, risks habitat deterioration.
Environment Policy 10
Requires Flood Risk Assessment in flood-prone areas per Appendix 4. No FRA submitted despite high risk location.
Environment Policy 13
Prohibits development causing unacceptable flood risk on/off-site. Raised levels displace water undemonstrated; use during flood endangers safety.
General Policy 2
Permits zoned development if respects landscape (b,c), safe access/traffic (h,i), no flood risk (l). Failed on landscape urbanisation, substandard splay, flood safety.
Wholeheartedly support as asset for residents, helps during road closures and TT, addresses major parking shortage on Old Church Road for playing fields users and local businesses.
Do not oppose revised plans subject to conditions on access, visibility splays, parking, turning, pedestrian gates, and opening times.
No objection, subject to compliance with Highway Act on surface water runoff.
Marown Memorial Playing Fields Ltd objects to the application due to traffic safety risks to children and vulnerable users, while DOI Flood Risk Management opposes it pending a full Flood Risk Assessment.
Key concern: flood risk from River Dhoo and impacts on Sewage Treatment Plant
Marown Memorial Playing Fields Ltd
ObjectionWe cannot understand the justification for the above application; we are able to provide adequate car parking for our regular users; we do fear that there might be an as yet undisclosed agenda behind the application; Exiting from this intersection is already extremely perilous given the restricted view and the volume of traffic on the main road; Nobody has approached us regarding this which we find to be unacceptable
Department of Infrastructure Flood Risk Management Division
ObjectionThe proposed land suffers from flooding from the River Dhoo and any construction in this field could have negative effects to the new Sewage Treatment Plant and Ellerslie Depot; FRM would like to see a full Flood Risk Assessment including flow modelling for any obstructions
Conditions requested: full Flood Risk Assessment including flow modelling for any obstructions
