Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
C 2. The storage building here by approved shall be used only in conjunction with the Bowling club and not for any other purpose.
REASON: To ensure the proposal is used in accordance with the application as assessed.
This application has been recommended for approval for the following reason. The proposed storage building has been designed and sited to comply with General Policy 2 of the IoM Strategic Plan 2016.

1.0 THE SITE 1.1 The application site is Ballaugh Bowling Club, Ballacrosha, Ballaugh which is located to the eastern side of Station Road and northwest of Ballaugh Bridge. Within Ballaugh Bowling Club is an existing single storey clubhouse and facilities, which is located to the north of the bowling green.
2.0 THE PROPOSAL 2.1 Proposed is the erection of a portal frame storage building to store materials and tools/machinery for the maintenance of the bowling green.
2.2 The building would be a portal frame metal construction with green cladding sheets. The building would measure 7m long x 5.5m wide and 3.1m to the ridge. The only opening would be in the gable end with a roller shutter door and a pedestrian width door.
2.3 The applicant notes; "The existing storage has reached the end of its useful life and cannot be safely repaired".
3.0 PLANNING POLICY 3.1 The application site is located within an area designated as predominately residential use under the IOM Development Plan Order 1982. The site is not within a Conservation.
3.3 The site is not within a Conservation Area, there are no registered trees on site nor is it within an area of flood risk. It is appropriate to consider the following planning policies from the Isle of Man Strategic Plan 2016;

Spatial Policy 4 Ballaugh is a named service centre

4.0 PLANNING HISTORY 4.1 22/00706/B - Erection of extension to club house to provide storage, toilet facilities and access. Approved.

6.0 ASSESSMENT 6.1 The fundamental issues to consider in the assessment of this planning application are;

6.1 The principle of development here would be acceptable as the building and that of the Bowling Green sit within the defined settlement of Ballaugh and is within a named settlement. As such the proposal would be in accordance with Strategic Policy 2 and Spatial Policy 4.
(ii) Visual Impact 6.2 The proposal would be sited within 3m of the existing club house and would be of a scale and height that would be proportionate to its sighting adjacent to an existing structure (club house). The club house is single storey with a pitched roof and this proposed storage building would be seen as complimentary to the clubhouse and visually read in conjunction. As such there would be no visual harm from the proposals and this aspect would accord with GP2b,c.
(iii) Impact on the neighbour's amenity 6.3 Given the proximity to the neighbouring dwelling to the north, the size and scale of the proposals would not result in any adverse impact upon their living conditions given the intervening distances (approx. 50m away) and the club house would be between the proposed building and the dwelling to the north. As such this aspect would accord with GP2g.
7.0 CONCLUSION 7.1 For the above reasons, it is concluded that the planning application would be in accordance with the land use designation and not considered have a detrimental visual impact and would comply with aforementioned planning policies of the Isle of Man Strategic Plan 2016, and is recommended for approval.
8.0 RIGHT TO APPEAL AND RIGHT TO GIVE EVIDENCE 8.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted).
8.2 Article A10 sets out that the right to appeal is available to: o applicant (in all cases); o a Local Authority; Government Department; Manx Utilities; and Manx National Heritage that submit a relevant objection; and o any other person who has made an objection that meets specified criteria.
8.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10.
8.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required): o any appellant or potential appellant (which includes the applicant); o the Department of Environment, Food and Agriculture, the Department of Infrastructure and the local authority for the area; o any other person who has submitted written representations (this can include other Government Departments and Local Authorities); and o in the case of a petition, a single representative.
8.5 The Department of Environment Food and Agriculture is responsible for the determination of planning applications. As a result, where officers within the Department make comments in a professional capacity they cannot be given the Right to Appeal.
