Officer’s Report
1.0 Description 1.1 The proposed application 23/01407/B for the construction of a new Sewage Treatment Works and creation of new vehicular access was approved at appeal on 16.07.2024 subject to 19 conditions, some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition (8) which the applicants are seeking to satisfy.
1.3 Specific wording of the condition is as follows:
Prior to the commencement of development, including works of site clearance and ground preparation, details of surface water drainage works shall be submitted to and approved in writing by the Department. The details to be submitted, which shall accord with the

25/10016/AIR principles set out in the drainage strategy at Section 8.2 of Volume 3 of the Environmental Statement, shall:
i) provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; ii) include a timetable for implementation; and iii) provide a surface water management and maintenance plan for the lifetime of the development.
Development shall be carried out in accordance with the approved details.
REASON: In order to reduce the risk of creating or exacerbating flood risk and to minimise the risk of pollution
2.0 Proposal 2.1 The applicants have submitted details providing information for the silt management plan along with a duly completed AIRC form on the 10.01.2025.
2.2 A detailed plan has been provided which the report is to be red in conjunction with.
2.2.1 o A filter/run off drain will be installed at bottom of each excavation batter on the high side of the site (see blue lines on the plan)
o These will allow us to control the water run-off from the site as the works progress.
o A bund will be installed along the river side of the main site works area, which will control any further run-off. The bund will be constructed to ensure the water falls towards the silt buster end of the works.
o The filter drain will wrapped in Terram Geotextile material and filled with 5" clean stone - the clean stone will help dissipate the energy in the water and filter the water also.
o The water will follow the filter drains to the low points where sediment mats will be installed to remove any sedimentation which remains in the water.
o In addition to the above the water will flow through a silt buster which will be installed on site. Following the silt buster, the water will enter the storage tanks installed as part of the main site works and enter into the river via the discharge pipe, again which is being permanently installed as part of the main project.
o Silt/Water from deep excavations will be pumped directly into the silt buster and follow the above flow
o There shall be NO direct pumping of contaminated water from the works to a watercourse at any time
2.3 Measures to control the storage, handling and disposal of polluting material -
o The storage, handling and disposal of the material will be manage as set out above via silt busters and filter drains in conjunction with sediment matts.
o The silt buster will be cleared on a regular basis and arisings will be disposed off at a licensed tip. This task will be managed the Site Manager via daily inspections

o Sediment matts will be inspected on a daily basis and will be changed as and when required
o All fuels/chemicals or other materials classified as hazardous will be kept stored within a bunded enclosed spillage tray or cabinet.
o Fuelling and lubrication of machinery is to be carried out a safe distance from a watercourse (in a designated bunded area).
o Machinery must not be leaking oil when carrying out the work.
o Any spillage of fuels, lubricants of hydraulic oils is to be immediately contained and the contaminated soil removed for proper disposal.
o No vehicles shall be left unattended when refuelling and a spill kit including an oil containment boom and absorbent pads shall be on site at all time.
o All vehicles shall be regularly maintained, washed and checked for fuel and oil leaks.
2.4 Construction of a sustainable drainage system or filtering of silt laden run-off -

2.5 Measures to ensure that work to existing surface water features does not case erosion - The new outfall to the River Neb will be constructed strictly in accordance with the Arcadis drawing for the works. This drawing and works have been agreed with DEFA. The works will involve working on the river bank and therefore will be undertaken in the period July - September (Inclusive) Prior to the commencement of these works, Safe Systems of work will be discussed, developed, and agreed with the MUA, DoI Flood Risk Management, DEFA

o Close Liaison with DEFA - Fisheries will be required. o Submission of S18 application. o Close Liaison with DoI - Flood Risk Management Engineers will be required. o Submission of S20 application. o Close Liaison with DoI Design Engineer will be required. o Close Liaison with Ecological Clerk of Works. o Other Key Stakeholders.
3.0 Consultation 3.1 The Department's Inland Fisheries Officers were consulted for advice on the satisfaction of condition. The advice received 07.03.2025, after their review of the submitted and updated documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
3.1.1 Comments provided are: Inland Fisheries Officers have been consulted in relation to application PA 23/01407/B;CONDITION - C8 SILT MANAGEMENT PLAN and subject to condition, have no objection. DEFA Fisheries confirm the Neb River contains fish, including salmon (Threatened species), trout and eels (Protected species) and have concerns due to the nature of the proposed works and potential impacts to this fishery. Having met with the project management and contractors on site, proposed controls of surface water are deemed adequate, with daily monitoring required to ensure these measures are effective. If ineffective, further mitigating controls must be employed due to the sensitive timing (migratory fish spawning season from November to June - inclusive) and valuable fishery this development may impact on. Department approval requires the applicant to;
Fisheries Division ask that all surface water is pumped to the filter/run off drain at its highest point to allow dirty water the greatest amount of filtering before reaching the "silt buster" before entering the Neb River.
The applicant is advised to contact Fisheries (tel. 685857, or email [email protected]) to discuss method statements and arrange an initial advisory site visit in conjunction with the DEFA EPU" 07.03.2025
3.2 The Department's Environmental Protection Unit were also consulted for advice on the satisfaction of condition. The advice received 18.03.2025, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.

25/10016/AIR 3.2.1 Comments provided are: "EPU have no comments or concerns with any of the documents provided below. We're satisfied that all proposed waste facilities hold the appropriate waste disposal licences, and suitable measures are being taken to protect the watercourse from pollution." 18.03.2025
4.0 Recommendation 4.1 In this instance of the submitted documentation and after consultation with the case officer confirming that they are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 8 of application 23/01407/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
