NOTE. In this instance of the submitted drawings and documentation provided and after consultation with the Case Officer from the original application, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 2 of application 22/01472/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.

Officer’s Report
1.0 Description 1.1 The proposed application 22/01472/B for the Refurbishment of the existing spillway at Cringle Impounding Reservoir was approved on 26.01.2023 subject to 2 conditions, some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition 2 which the applicants are seeking to satisfy.
1.3 Specific wording of the conditions are as follows:

25/10023/AIR The development hereby approved shall not be commenced until details of a 'Construction Environment Management Plan', which details the roles, responsibilities, training, procedures and monitoring on site which will ensure that the environment is protected during all phases of the development and all environmental legislation and policy is adhered to, and will need to include at least the following: A methodology for the removal, storage and replacement of species rich grass land turfs, and protection measures to be put in place to prevent damage to the surrounding grassland; Reasonable Avoidance Measures (RAMs) for lizards; Measures to prevent the entrapment of animals; Measures to prevent the pollution or damage of the Silverburn River and the stilling basin (which has some nice plant populations)". All works carried out during the construction period shall be undertaken strictly in accordance with the approved CMP.
2.0 Proposal 2.1 The applicant's agent has submitted a detailed documents and drawings highlighting Construction Environmental Management Plan (CEMP) and the Grassland Protection Methodology at Cringle Impounding Reservoir.
2.2 There has been a detailed table providing information on the Proposed Environmental Responsibility. The Contractor's Project Manager is in charge of: Ensure that the CEMP is produced, maintained, approved by DEFA Planning and Building Control and implemented and distributed to all relevant parties.
2.3 It is noted that: The CEMP will be a live document that will be subject to change when the need arises. All construction related activities taking place on and around the proposed development site will be subject to controls. Where these controls are found to be deficient or improvement to procedures is identified, the CEMP will be updated to reflect these improvements. The CEMP will be monitored throughout the course of the project by the Project Manager in conjunction with the Environmental Representative and Ecology Clerk of Works. All monitoring and inspection reports are to be documented, recorded and retained for inspection. Any corrective actions will be detailed in a corrective actions checklist, which will detail the actions, name a responsible person and the required timescales. Environmental training/induction will be available for all site staff prior to working on site. Ongoing training and review of relevant procedures will be in place with site staff throughout the contract.
3.0 Consultation 3.1 Miss Sophie Costain from the Department's Ecosystem Policy Team was consulted for advice on the satisfaction of condition. The advice received 18.02.2025 after their review of

25/10023/AIR the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 Recommendation 4.1 In this instance of the submitted drawings and documentation provided and after consultation with the case officer from the original application, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 2 of application 22/01472/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
