TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Steve Blackford, Ref 25/90093/B, for the Demolition of existing ticket office, removal and storage of entrance gates and turnstiles, erection of new visitor's hub and maintenance vehicle access gate (in association with 25/00103/CON) at Laxey Wheel Visitor Entrance Mines Road Laxey Isle Of Man IM4 7NL .
Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
All planting shall be carried out in accordance with the approved details and maintained for the lifespan of the building. Any plants indicated on the approved scheme which from the date of planting, die, are removed or become seriously damaged or diseased shall be replaced during the next planting season with other plants of a species and size in accordance with the maintenance schedule.
Reason: In the interests of the character and appearance of the site and surrounding area. Notwithstanding the details provided within this application, the proposed flat roof will be a sedum roof and retained as such thereafter. No development shall be commenced until a soft
planting scheme sedum roof has been submitted to and approved in writing by the Department. Such a scheme shall include a planting specification, a programme of implementation and a maintenance schedule.
Reason: To enable the Department to consider the implications of any subsequent change of use on the amenities of the area.
Reason: The building has been exceptionally approved solely to meet a need and its subsequent retention would result in an unwarranted intrusion in the countryside.
Reason: To prevent the creation of an additional kiosk on the site which would be contrary to planning policy and in order to safeguard the countryside for its own sake.
This decision relates to the following plans and drawings, date stamped received on 27th January 2025;
This decision also relates to Drawing No. JTM2402-P-02 Rev A dated received 18th February 2025, and an email confirm the sedum roof dated received 9th April 2025.
This decision has been made for the following reasons(s)
The proposal is deemed to comply with Section 18(4) of the Town and Country Planning Act 1999, Strategic Policy 4, General Policy 2, Environment Policy 35 and Environment Policy 40 of the Isle of Man Strategic Plan and Policy's CA/2 & CA/4 of Planning Policy 1/01, as such the proposal is recommended for approval.

This decision was made by the Planning Committee in accordance with the authority delegated to it.
This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —
Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.
Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.
Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
