Strategic Policy 4

Requires development to protect or enhance the fabric and landscape quality of a Conservation Area. The officer assessed that the window replacements would harm the terrace's character, failing to protect the special architectural features like the 2/3-1/3 fenestration.

General Policy 2

Permits development in accordance with zoning if it meets criteria including (c) not adversely affecting townscape character and (g) not adversely affecting locality character. The proposal fails these as the uPVC 50/50 windows would detract from the Conservation Area terrace's uniform sash window pattern.

Environment Policy 35

Requires development to preserve or enhance the character or appearance of Conservation Areas. The change from timber sash to uPVC casement without matching proportions was found to neither preserve nor enhance the area's special character.

Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man

Policy CA/2 requires impact on Conservation Area character to be a material consideration. Great weight given to conservation led to refusal as proposal detracts from the asset.

For Conservation Area buildings, visible replacement windows must match original method of opening, glazing bar pattern, and frame sections. Proposed 50/50 uPVC casements do not match the site's 2/3-1/3 sash with bars.
