C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
This application has been recommended for approval for the following reason.
Overall, the proposal is considered to have a neutral impact on the character and appearance of the Conservation Area in accordance with Environment Policy 35 and with no adverse impact on the living conditions of those in surrounding areas, in accordance with General Policy 2 of the Strategic Plan. Furthermore, the scheme would serve to provide an alternative source of energy supply for the property, and is judged to align with the environmental objectives and policies set out in the Strategic Plan. The proposal is, therefore, considered to comply with General Policy 2, Environment Policy 4 and Environment Policy 35 of the Isle of Man Strategic Plan 2016, in conjunction with Planning Policy 1/01.
Plans/Drawings/Information; This decision relates to the documents and plans received 21 October 2024. _________________________________________________________________ Right to Appeal It is recommended that the following organisations should NOT be given the Right to Appeal:
1.0 THE SITE - 1.1 The application site is the residential curtilage of "Dhrynane House," previously "Thie Dhrynane," Maughold, which is a traditional two storey property situated to the eastern side of Maughold Village and to the west of Maughold Church. - 1.2 This property which has its southern, western and eastern boundaries of the site enclosed in mature hedging, with mature trees also spread along sections of its boundary, has a pitch roofed detached garage which sits southwest of the main dwelling on site, and behind a group of mature trees situated along the western side of the main access. - 1.3 farm Lane runs along the rear (southern) boundary of the site and separates the property from the neighbouring field (Field 624092) which sits just south of the application site and the neighbouring dwelling Baldromma Mooar.
2.0 THE PROPOSAL - 2.1 Planning approval is sought for Installation of 8 solar panels to roof of detached garage. These Hi-Mo LR5-54HIB solar panels would each measure 1722mm x 1134mm, and would all be installed over the rear roof plane of the garage. - 2.2 There is a discrepancy on the application form which indicates that 10 solar panels would be installed. However, the cover letter and details on the application drawings show that 8 solar panels are to be installed. As such, the scheme assesses the installation of eight (8) solar panels.
3.0 PLANNING POLICY - 3.1 Site Specific:
3.3 National policy: THE ISLE OF MAN STRATEGIC PLAN 2016
(4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act.
3.4 Planning Policy Statements: 1/01 POLICY AND GUIDANCE NOTES FOR THE CONSERVATION OF THE HISTORIC ENVIRONMENT OF THE ISLE OF MAN
5.1 The property has been the subject of a number of previous planning applications none of which are considered relevant in the assessment and determination of the current application. - 6.0 REPRESENTATIONS Copies of representations received can be viewed on the Government's website. This report contains summaries only.
6.1 DOI Highways have no Interest (24 October 2024).
6.2 Garff Commissioners have noted that all the panels are on the rear aspects of the garage and would not be viewable from any public perspectives. They resolved to submit no objections (11 November 2024). - 6.3 No comments have been received from neighbours.
7.1 The fundamental issues to consider with this application is whether the proposal would result is any adverse impact on the character or appearance of the existing property or the wider street scene, and Conservation Area, the potential impacts on neighbours, and the wider environmental concerns.
7.4 Impacts on Neighbours (GP2 & EP 22).
8.1 The proposal is considered to have a neutral impact on the character and appearance of the Conservation Area in accordance with Environment Policy 35 and with no adverse impact on the living conditions of those in surrounding areas, in accordance with General Policy 2 of the Strategic Plan. Furthermore, the scheme would serve to provide an alternative source of energy supply for the property, and is judged to align with the environmental objectives and policies set out in the Strategic Plan (EnP 4). For the above reasons, the proposal is considered to comply with General Policy 2, Environment Policy 4 and Environment Policy 35 of the Isle of Man Strategic Plan 2016, in conjunction with Planning Policy 1/01, and is therefore acceptable. - 9.0 RIGHT TO APPEAL AND RIGHT TO GIVE EVIDENCE
9.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted).
9.2 Article A10 sets out that the right to appeal is available to:
9.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10.
9.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required):
