Tel 01624 685950 Mr Wayne Lewthwaite 23 Market Street Douglas Isle of Man IM1 2PA TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Ms Kelly McCullough, Ref 24/90980/B, for the Installation of external personnel door on east elevation; change use of building from brewery and associated offices into a gymnasium with associated facilities at Former Brewery Leigh Terrace Douglas Isle Of Man IM1 5AL . Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes). 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals. 2. The use of the premises shall only be for the purposes of a gymnasium and for no other use falling within Use Class 4.4 of the Town and Country Planning (Use Classes) Order 2019. Reason: Permission has been granted solely on the basis and merits of the proposed use. Any subsequent change of use of the premises within the same use class would require further assessment. 3. Customers will only be permitted onto the premises between the following hours: 06:00 - 21:00 Monday to Thursday 06:00 - 20:00 Friday 08:00 - 14:00 Saturday 09:00 - 14:00 Sunday Reason: The application has been assessed on the basis of the opening hours provided as part of the submission. Any extension to opening hours would require further assessment in the context of residential amenity considerations.

The development, hereby approved, shall be implemented solely in accordance with the approved floorplans, as shown on Drawing. No. WL-24-1599-2A, and thereafter retained as such for the lifetime of the development. Reason: The application has been assessed solely on the basis of the approved layout. Any deviation to the layout and introduction of additional activities would require further assessment in the context of residential amenity considerations. 5. Prior to the occupation of the development, all external windows shall be fixed shut and thereafter remain non-opening. Reason: To reduce noise impacts and in the interests of residential amenity. 6. The on-site car parking provision and in premises cycle parking provision as shown on Drawing No. WL-24-1599-2A shall be provided prior to the first use of the premises for the Gym Use, hereby permitted. Thereafter, these arrangements shall be retained and maintained for the lifetime of the development. Reason: To ensure adequate on-site car parking provision and in premises cycle parking provision are provided to serve the development in the interests of highway safety. Tel 01624 685950 Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it. This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation. A copy of the Officer’s report and any correspondence which informed the assessment and decision is available to view on the Government’s website (via https://pbc.gov.im/online- applications/) Implementation A determination to grant planning approval does not have effect - if an appeal is submitted until the appeal is determined or withdrawn; or if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice). Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation. Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action. Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
