INTRODUCTION

The following application is to be assessed against the criteria set out in Part 3 - Minor Changes Applications of the Town and Country Planning (Development Procedure) Order 2019 specifically Articles 21, 22, 23 and 24.

BASIS OF APPLICATION

DETERMINATION

23(1)(a) The Minor Change does not significantly increase the size or scale of the development in question

FAIL - The changes proposed would increase the size and scale significantly from the original approval.

23(1)(b) The Minor Change does not significantly change the nature of the development in question

FAIL - The original approval was for the rebuild of the existing garage building with the replacement of a new garage and bedroom accommodation over connected to the main house. An existing single story conservatory to the rear of the property was to be demolished and rebuilt. The introduction of a second floor over the existing single story sunroom would significantly change the nature of the development and further consideration in the way of a full planning approval is needed. Further, the site is also not designated for development.

23(1)(c) The Minor Change does not result in an approval which, at the time of approval, complied with a Development Plan, National Policy Directive or a Planning Policy Statement, ceasing to do so

FAIL - There is a new larger window being introduced at this level where the window that was included in the original approval was set back further from the nearest property, this would only have been considered a secondary window given that it was situated within a hallway whereas what is proposed in the minor change would be a primary window given that it is in a bedroom. It is considered that there would be an increased impact on the neighbouring property.

23(1)(e) The Minor Change is not more than minor and is not of a magnitude to warrant a new application

FAIL - This amendment would not be considered a minor change.

23(1)(f)The Minor Change does not otherwise fundamentally change the basis on which the grant was originally made.
