Officer’s Report
1.0 Description
1.1 The proposed application 19/01057/B was approved on 25.09.2024 for the conversion and extension of redundant mill to create residential dwelling with additional tourist use subject to 6 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Conditions 3 which the applicants are seeking to satisfy.
1.3 Specific wording of the condition as follows:

24/10098/AIR Prior to the undertaking of any works including clearance, a written method statement for the details and timing of works to be undertaken within the watercourse, shall be provided to and approved in writing by the Department. The works shall be carried out in full accordance with the approved details.
Reason: to safeguard the watercourse and any fish within it.
2.0 Proposal
2.1 The applicant's agent has submitted a Construction Environmental Management Plan. The plan provides details on the how the construction will be managed with regards to the River Neb watercourse and how potential effects will be avoided, minimised or otherwise mitigated. They go on to state in the report that no personnel or machinery will be required to enter the watercourse throughout the construction however if this was to change they will contract the Environmental Directorate beforehand and update the CEMP.
2.2 The plan also outlines how the storage of harmful materials and plant and equipment washing will take place on the hard standing located far away from the watercourse. The site will also be enclosed with temporary secure perimeter fencing to ensure machinery and personnel cannot interfere with the bankside of the watercourse and any educating of foreseeable risk to the watercourse will be taken on all operatives during site induction.
3.0 Consultation
3.1 DEFA Inland Fisheries were consulted for advice on the satisfaction of condition. The advice received on 18.09.2024, after their review of the submitted documents, concludes that they are pleased that the information satisfies the relevant clauses.
4.0 Recommendation
4.1 In the instance of the submitted Construction Environmental Management Plan and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient and would be considered satisfactory for planning condition 3 of application 19/01057/B with the understanding that the works shall be carried out in full accordance with the approved details.
