Many thanks for your swift response, and for your advice which we have sought to incorporate.
We have amended our drawings to specify a lower power output to the rear terraces. Sensor locations and angles of detection have also been shown. Control notes have been added to drawing 1612-100.12 (revision B) confirming an inactive period between 2am and 6am.
Operatives will be advised accordingly regarding statutory obligations under the Wildlife Act 1990 and Fisheries Act 2012.
I’d appreciate it if you could please confirm by email if the attached amended information accords with the requirements to discharge Conditions 4, so that we may advise Planning accordingly.

Proposed mitigation of condition 4 is for; The rear terraces will have opaque masonry parapets; down-lighting to these areas has been located behind the parapets and directed away from the watercourse.
I suggest low power lighting use (as proposed for the front terrace) including motion sensor activation, and to include an ‘inactive lighting’ period (between 2am - 6am) to further protect migratory fish from light becoming a barrier to passage, which is an offence under the Fisheries Act 2012;Sections 11 & 32. The reason for these measures are to negate any impact to fish as the River Neb is a high value environment, inhabited by threatened iconic fish species such as Atlantic salmon and eels.
This advice relates to condition 4 on the application and condition 3 has not been specified within this response as development will is intended not be directly involving any physical disturbance to the river, as stated in the received Construction Environmental Management Plan (CEMP) which determined; 6.1 - There is sufficient distance between the Development and the Watercourse for the construction of the Development without interference to the banksides of the Watercourse. 6.2 - It is anticipated that neither machinery nor personnel will be required to enter the Watercourse during the Development’s construction (or at all). 6.3 - Should any entry into the watercourse be required at any time, prior notice will be provided to the Environment Directorate and the CEMP will be amended as required. Such activity will in any event be restricted to a period between July and September (inclusive) in order to avoid disturbance or injury to spawning fish, or to the spawn and fry of fish, during the season in which they are most at risk, as required by Inland Fisheries Division.

I hope all is well with you, I had tried to give you a quick call this afternoon but assume you are out of the office.
There are two conditions attached to the above approval that we are looking to discharge. These concern works proximate to the watercourse (Condition 3) and lighting (Condition 4) - please see the attached Decision Notice.
Building Control approval was obtained last Friday and works need to start as soon as possible in compliance with Condition 1. We have therefore submitted two AIR applications regarding each of the two conditions - also attached.
The method statement regarding works proximate to the watercourse uses the same or similar precautions to those we have employed on another riverside project, and which met DEFA’s requirements.
The lighting design has been prepared to direct all light away from the riverside, to avoid the previously identified risk to bats and fish. Low-power lighting to the front of the building and forecourt will be obscured from the river by the mill structure itself. The rear terraces will have opaque masonry parapets; down-lighting to these areas has been located behind the parapets and directed away from the watercourse.
In an effort to expedite this matter I would greatly appreciate it if you could please review the attached so that the conditions may be discharged. Please don’t hesitate to call me if you have any questions.
