Tel 01624 685950 Mr Martyn Hobson Architectural Studio 7 Olafs Close Douglas IM2 7AR TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019 In pursuance of powers granted under the above Act, and subordinate Orders and Regulations, the Department of Environment, Food and Agriculture determined to REFUSE an application by Mrs Anne Thomson, Ref 24/90934/B, for the Erection of a detached machinery storage Building at Field 430685 Swallows Rest Bayrauyr Road St Marks Ballasalla Isle Of Man IM9 3AT for the following reason(s): 1. In light of the appeal decision in 2021 removing the agricultural tie and the evidence presented which demonstrated that there was no agricultural activity taking place and that it was also unviable as a business, the Department considers that there is no justification for an agricultural building and that no agricultural need exists as such the proposals conflict with General Policy 3(f) and Environment Policy 15. This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation. A copy of the Officer’s report and any correspondence which led to the assessment and decision is available to view at gov.im/viewapplications A determination to refuse planning approval does not have effect - • if an appeal is submitted until the appeal is determined or withdrawn; or • if no appeal is submitted, until the time within which an appeal may be submitted has expired (21 days from the date of this notice).
