Tel 01624 685950 TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr & Mrs Ann & David Giroux, Ref 25/90623/B, for the Alterations to driveway, including construction of a new entrance gate, stone piers and boundary wall at Holly Lodge (Refectory) Bishopscourt Kirk Michael Isle Of Man IM6 2EZ . Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes). 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals. 2. No site works or clearance shall be commenced until a detailed method for the construction of the boundary wall hereby approved within the rooting area of Registered Tree 4125 and tree group G1 has been submitted to and approved in writing by the Department. Works shall take place in accordance with the approved details. Reason: To safeguard the existing trees and planting to be retained within the site. 3. No works or site clearance shall take place until protective fences which conform with British Standard 5837:2012 (or any British Standard revoking and re-enacting British Standard 5837:2012 with or without modification) have been erected around the existing trees shown to be retained on the approved plans. Unless and until the development has been completed these fences shall not be removed and the protected areas are to be kept clear of any building, plant equipment, material, debris and trenching, with the existing ground levels maintained, and there shall be no entry to those areas except for approved arboricultural or landscape works. Reason: To safeguard the existing trees and planting to be retained within the site. 4. The existing trees to be retained shall be retained in accordance with the approved details. Any retained tree which within five years of the approved development being completed dies, are removed or become seriously damaged or diseased shall be replaced by a similar species, of a size to be first approved in writing by the Department, during the next planting

Tel 01624 685950 season or in accordance with a programme of replacement to be agreed in writing with the Department. Reason: To safeguard the appearance of the development and the surrounding area. 5. All materials to be used in the construction of the development hereby approved shall be as stated on the approved plans in respect of type, size, colour, bond, pointing, jointing, profile and texture unless alternative details are first submitted to and approved in writing by the Department. Works shall be carried out in accordance with the approved details. Reason: In the interests of the setting of adjacent Registered Buildings and the character and appearance of the site and surrounding area. This approval relates to the following drawing numbers: o PLR01 - Location Plan o PLR03 - Proposed Plan o PLR04 - Proposed Elevation o PLR05 - Section A o PLR06 - Typical Boundary Wall Section Details o PLR07 - Pier Copings and Lantern Detail o AIA-060625 - Arboricultural Impact Assessment o TS-160625 - Tree Constraints Plan o TR-160625-a - Tree Removal Plan o PP-160625-a - Tree Planting Plan o OTP-160625-a - Outline Tree Protection Plan NOTE A S109 highway agreement will be required for the proposed vehicular access and stopping up the existing garage access. This decision has been made for the following reasons(s) The proposed development would enhance the setting of the Registered Buildings at Bishopscourt and cause no harm to the character and appearance of the area more generally. The loss of the Registered Trees to the east of the entrance is justified on account of their poor health, and compensation would be provided in the form of two new Hornbeams. The entrance would cause no harm in respect of highway safety and it might represent an improvement to the existing arrangements on this fast stretch of road. Tel 01624 685950 Guidance Note This decision was made by a Principal Planner in accordance with the authority delegated to them. This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation. A copy of the Officer’s report and any correspondence which informed the assessment and decision is available to view on the Government’s website (via https://pbc.gov.im/online- applications/) Implementation A determination to grant planning approval does not have effect - · if an appeal is submitted until the appeal is determined or withdrawn; or · if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice). Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation. Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action. Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
