Tel 01624 685950 TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Miss Lisa Samaras, Ref 25/90672/B, for the Additional use of workshop as occupational therapy facility at Lakeside Patrick Road St Johns Isle Of Man IM4 3BP . Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes). 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals. 2. The development shall be completed in accordance with the materials as indicated on the approved drawings and within the approved Planning Statement dated January 2025. 3. The use as an Occupation Health Therapy facility hereby approved shall not be undertaken outside the following times: 08:30 - 17:00 and Monday to Friday and 08:30 - 13:00 Saturday. The use shall not be undertaken at any time on Sundays and/or Public Holidays. Reason: In order to maintain the amenities of the area. 4. The Occupation Health summer school use hereby approved, shall be limited to a maximum of 5 weeks per calendar year, with no more than 10 clients attending the site at any one time. Reason: To avoid an overly intensive use of the site that may require further consideration by the Department, in the interest of amenity and highway safety in the area. 5. Notwithstanding the provisions of Schedule 1, Class B of the Town and Country Planning (Permitted Development) (Temporary Use or Development) Order 2015 or any Order revoking and/or re-enacting that Order with or without modification), there shall be no temporary uses

Tel 01624 685950 on the land subject of the application, other than that expressly authorised by this approval, without the prior written approval of the Department. Reason: The site is located in the countryside and the use is justified on the individual needs of the applicant, which would need to be reassessed should an alternative use be proposed. 6. The use hereby permitted shall benefit the applicant, Lisa Samaras, only in conjunction with the business known as Victory Occupational Therapy, and by no other individual or business whatsoever. Reason: The site is located in open countryside and the development is justified on the personal needs of the applicant only. 7. Notwithstanding the Town and Country Planning (Use Classes) Order 2019, the use hereby permitted shall be limited to an Occupational Therapy facility only, for individual and group therapy sessions and for no other purpose unless otherwise approved in writing by the Department. Reason: The site is located in the countryside and the use is justified on the individual needs of the applicant, which would need to be reassessed should an alternative use be proposed. This decision relates to the following plans and drawings, date stamped 10 Jand 11 June 2025: 01P Location Plan 02P Site Plan 03P Existing Plan and Elevations 04P Proposed Plan and Elevations Planning Statement This decision has been made for the following reasons(s) The proposed development will make good use of an existing ancillary building, allowing the applicant to enhance their Occupational Therapy service to the benefit of the community and health services on the Island. The development will not give rise to any unacceptable impacts upon visual or residential amenity, or highway safety. Tel 01624 685950 Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it. This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation. A copy of the Officer’s report and any correspondence which informed the assessment and decision is available to view on the Government’s website (via https://pbc.gov.im/online- applications/) Implementation A determination to grant planning approval does not have effect - · if an appeal is submitted until the appeal is determined or withdrawn; or · if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice). Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation. Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action. Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
