Officer’s Report
1.0 Description 1.1 The proposed application 24/00135/B for the demolition of all existing buildings on site and replacement with a building accommodating shop (Class 1.1) or food and drink floorspace (Class 1.3) on the ground floor with seven apartments (Class 3.4) and associated bin and cycle storage was approved on 12.12.2024 subject to 7 conditions, some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition (2) which the applicants are seeking to satisfy.
The specific wording of the condition is as follows:
No works of demolition shall begin before evidence has been submitted to the Department of a binding contract for the full implementation of the comprehensive scheme of development of the site in accordance with all the necessary permissions and consents.
REASON: In order to ensure the satisfactory redevelopment of the application site prior to the existing building loss in accordance with Environment Policy 30 of Strategic Plan 2016

25/10074/AIR and that an unsightly gap or derelict site does not detract from the character and appearance of the area. 2.0 Proposal
2.1 The applicant's agent has submitted a contract of works along with a duly completed AIRC form on the 20.05.2025.
2.2 The contract clearly outlines the persons proposed to commence the works and has been signed by all parties.
3.0 Consultation 3.1 The condition as worded did not require the details to be approved in writing by the Department, rather just provided - as such, no consultation has been made.
4.0 Recommendation 4.1 In this instance of the submitted documentation and after consultation with the relevant Department confirming that they are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 2 of application 24/00135/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
