This application has been recommended for approval for the following reason. It is judged that the proposed position, form, scale and design of the signage within this application is appropriate to its site, and as such the proposals would result in no loss of amenity and would have no negative impact on public safety. As a result of the scale, position and form of the signage, the proposals are judged to meet the tests of General Policy 2, Strategic Policy 4 and Environment Policy 37 as the character of the conservation area and surrounding townscape would be preserved. The application is therefore judged to be acceptable.

Officer’s Report
1.0 THE SITE
1.1 The site is Paramount City, Queen's Promenade, Douglas. The site is located in the Douglas Promenades Conservation Area.
2.0 THE PROPOSAL
2.1 This application seeks express consent to erect illuminated signage on the front elevation and signage on removable hoardings around seating areas in front of the building's principal elevation. The application is concurrent with 24/91388/B, which seeks approval for the decking and elements of the surrounding hoarding.
2.2 The proposed signage on the building's front elevation would be a 6.1mx1.08m Di-Bond sign with a 5mm Acrylic Logo. The Sign would have black writing on a white background. External track lighting would be installed behind the sign, lighting the seating area and fixed to the underside of a projecting portion of the building's first floor.
2.3 The proposed banners around the seating areas would be 1m high through, with some banners 1.2m long and some 1.5m long. These banners would have a black background with paramount city name and logo in white. The poles supporting the banners are proposed to be in stainless steel.
3.0 PLANNING POLICY
3.1 The site is in an area defined as mixed use in the Area Plan for the East 2020, and within the Douglas Promenades Conservation Area.

3.3 Planning Policy Statements: 1/01 Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man
POLICY CA/2 SPECIAL PLANNING CONSIDERATIONS When considering proposals for the possible development of any land or buildings which fall within the conservation area, the impact of such proposals upon the special character of the area, will be a material consideration when assessing the application. Where a development is proposed for land which, although not within the boundaries of the conservation area, would affect its context or setting, or views into or out of the area; such issues should be given special consideration where the character or appearance of a conservation area may be affected.

(a) in the case of amenity, the general characteristics of the locality, including the presence of any feature of historic, architectural, cultural or similar interest, disregarding, if they think fit, any advertisement being displayed there; (b) in the case of public safety - (i) the safety of any person who may use any road, railway, tramway, harbour or aerodrome; and (ii) whether any display of advertisements is likely to obscure or hinder the ready interpretation of, any traffic sign, railway or tramway signal or aid to navigation by water or air.
4.0 OTHER MATERIAL PLANNING CONSIDERATIONS
4.1 TOWN AND COUNTRY PLANNING ACT 1999
S18 Designation of conservation areas (4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act.
5.0 PLANNING HISTORY
5.1 There are various historic applications in relation to the building's previous use as a nightclub. The only historic application judged to be of relevance to the current proposal is 21/00421/B, which approved the conversion existing nightclub/public house to create first & second floor residential area and ground floor mixed use cafe/barbers shop including outdoor seating area.
6.0 REPRESENTATIONS Copies of representations received can be viewed on the government's website. This report contains summaries only.
6.1 DOI Highways - After reviewing these Applications, Highway Services HDC finds it to have no significant negative impact upon highway safety, network functionality and/or parking (18.6.2025).
6.2 Douglas City Council have stated that they have no objection to the application (24.6.2025).
7.0 ASSESSMENT
Statutory Test 7.1 Section 18 of the Act requires the Department to pay special attention to the desirability of preserving or enhancing the character or appearance of any conservation area in the exercise of any powers under the Act. In this instance, the application proposes signage on the building's front elevation and on removable hoardings/banners around a raised seating area. The form, size and position of the signage both on the building and on the hoardings/banners is judged to be appropriate to the building and its site, and as such the character and appearance of the conservation area is considered to be preserved.
Policy Tests 7.2 As outlined in section 7.1 above, this application proposes signage on the building's front elevation and on removable hoardings/banners around a raised seating area. The size and position of the signage, together with the lighting and proposed removable poles that would support the banners, is judged to be of a style, size, position and style that would result in no harm to the amenity of the building or the surrounding locality.

7.3 With regard to public safety, DOI Highways have stated that they judge the application to have no significant negative impact. Given the position, scale and form of the proposed signage, I agree with this assessment and judge that the proposals would result in no danger to public safety.
8.0 CONCLUSION
8.1 It is judged that the proposed position, form, scale and design of the signage within this application is appropriate to its site, and as such the proposals would result in no loss of amenity and would have no negative impact on public safety. As a result of the scale, position and form of the signage, the proposals are judged to meet the tests of General Policy 2, Strategic Policy 4 and Environment Policy 37 as the character of the conservation area and surrounding townscape would be preserved. It is therefore recommended that the application be approved.
9.0 INTERESTED PERSONS STATUS
9.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) any Government Department that has made written submissions relating to planning considerations with respect to the application (whether pursuant to a notice under regulation 10 or otherwise) that the Department considers material; (c) the local authority in whose district the land the subject of the application is situated; and (d) the Highways, Ports and Railways divisions of the Department of Infrastructure.
9.2 In addition to those above, the Regulation 11(3) requires the Department to decide which persons (if any) who have made written submissions with respect to the application (whether pursuant to a notice under regulation 10 or otherwise), other than those referred to in paragraph (4), should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application.
9.3 The Department of Environment Food and Agriculture is responsible for the determination of planning applications. As a result, where officers within the Department make comments in a professional capacity they cannot be given Interested Person Status.
