Planning Status
Within the adopted Isle of Man Strategic Plan, the following policy is considered to be relevant to the assessment and determination of this application: General Policy 2, Housing Policy 17, Environment Policy 35
Assessment
The application site is within a Conservation Area. The proposal convert the existing living accommodation above the shop into three flats and to alter the shop front.
In respect of the alterations to the shopfront, the neighbouring property has a similar shopfront arrangement. The agents have been in consultation with the Conservation Officer regarding the alterations. The Conservation Officer is content with the shopfront alterations and would not adversely affect the character and appearance of the Conservation Area.
The application is also proposing to replace the existing first floor and second floor uPVC and timber windows on the front elevation with timber sliding sash windows. This is an improvement on the existing windows and would enhance the character and appearance of the Conservation Area.
In respect of the proposed conversion, the proposed apartment will all have front to rear access. All of the apartments have a clear and pleasant outlook. The proposed conversion accords with Housing Policy 17 of the Strategic Plan.
RECOMMENDATION It is recommended that planning permission be granted subject to conditions. PARTY STATUS
The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Highways Division of the Department of Transport is now part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.
The Manx Electricity Authority and the Environmental Health Officer of the Department of Environment, Food and Agriculture have commented on non-planning matters and as such should not be afforded party status.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

This permission relates to the conversion of the existing living accommodation into three flats and alterations to the shop front as shown in drawing numbers 105, 01 and 02 date stamped 23 December 2010, 101C and 103C date stamped 15th February 2011.
