6.0 ASSESSMENT
Statutory Test 6.1 Section 16 of the Act states that the "Department shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses." In this instance, the application proposes to remove a chimney that is sited on the north-eastern elevation. The chimney is situated on the single storey rear extension, and extension that was constructed in the late 20th century. The removal of this chimney will result in no physical alterations to the historic part of the building. In addition, given the scale and location of the chimney, it is judged that the removal of the chimney would cause no harm to the registered building's setting. With these factors in mind, it is judged that the special interest of the building and its setting would be preserved. Given the location of the chimney and the presence of dense planting on the property's boundary with the adjacent tennis courts, the proposed removal of the chimney is also judged to cause no harm to the character or appearance of the conservation area.
