Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
This application has been recommended for approval for the following reason.
The proposals meet the tests of Section 16 and 18 of the Town and Country Planning Act 1999, and the tests of General Policy 2, Strategic Policy 4, Environment Policy 32 and Environment Policy 35 of the Strategic Plan 2016, as the special interest of the Registered Building and Conservation Area are being preserved and protected, and the proposals respect the character of the surrounding townscape. It is therefore judged that the application is acceptable.

1.0 THE SITE - 1.1 The site is Crofton, The Crofts (RB 261), Castletown. The property was built sometime between 1850 and 1861, for an advocate named John Moore Jeffcott. The house is constructed in local Limestone, has a distinctive and unusual design, and retains much of its historic detailing.
2.0 THE PROPOSAL - 2.1 The application seeks approval for removal of a chimney stack on a single storey rear extension. The application is concurrent with registered building consent application 24/00645/CON.
3.0 PLANNING POLICY. - 3.1 The site lies within an area designated on the Area Plan for the South 2013 as predominantly residential, and within the Castletown Conservation Area. 5.0 REPRESENTATIONS - 5.1 No comments have been received.
6.0 ASSESSMENT Statutory Test - 6.1 Section 16 of the Act states that the "Department shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses." In this instance, the application proposes to remove a chimney that is sited on the north-eastern elevation. The chimney is situated on the single storey rear extension, and extension that was constructed in the late 20th century. The removal of this chimney will result in no physical alterations to the historic part of the building. In addition, given the scale and location of the chimney, it is judged that the removal of the chimney would cause no harm to the registered building's setting. With these factors in mind, it is judged that the special interest of the building and its setting would be preserved. Given the location of the chimney and the presence of dense planting on the property's boundary with the adjacent tennis courts, the proposed removal of the chimney is also judged to cause no harm to the character or appearance of the conservation area. Policy Tests - 6.2 The application proposes to remove a chimney that is sited on the north-eastern elevation. The chimney is situated on the single storey rear extension, and extension that was constructed in the late 20th century. 7.0 CONCLUSION - 7.1 It is judged that the proposals meet the tests of Section 16 and 18 of the Town and Country Planning Act 1999, and the tests of General Policy 2, Strategic Policy 4, Environment Policy 32 and Environment Policy 35 of the Strategic Plan 2016, as the special interest of the Registered Building and Conservation Area are being preserved and protected, and the
proposals respect the character of the surrounding townscape. It is therefore recommended that the application be approved.
