General Policy 2
Requires development to respect site/surroundings in siting, layout, scale, form, design; not adversely affect landscape character; integrate with topography/landscape features. Officer found proposal fails (c) due to prominent, incongruous form from elevated siting, fencing, raised garden on exposed site, not sensitively integrated.
General Policy 3
Permits countryside development only in exceptional cases like overriding national need (g). Officer assessed and found no compliance with any criteria; single-unit tourism benefits do not outweigh countryside protections despite Visitor Economy Strategy.
Environment Policy 1
Protects countryside from adverse development unless overriding national need with no alternative. Site in countryside; no such need established for tourism unit, causing harm.
Environment Policy 2
Protects AHLV character unless no harm or essential location. Proposal harms character/quality via prominent features on exposed site in Landscape Character Area D1.
Strategic Policy 2 - Priority for new development to identified towns and villages
Requires positive environmental contribution via design. Proposal's features conflict.
Business Policy 11
Tourism must comply with countryside policies with equal weight. Fails General Policy 3.
Business Policy 14
Rural tourism permitted if complies with Plan policies including GP3/BP11. Does not comply.
No significant negative impact upon highway safety, network functionality and/or parking as the proposed access is acceptable for the relatively small nature of the proposals and the considered low flow rural nature of Maughold Road. Conditions should include the proposed access, vehicle hardstanding, grasscrete and parking layout shown on the approved plans to be implemented before first occupation and retained thereafter.
Highway Services HDC has no objection to application 24/00591/B, finding no significant negative highway impacts and recommending conditions for access and parking implementation. DOI Highways Drainage recommends awareness and compliance with drainage requirements to prevent surface water runoff onto the highway.
Key concern: surface water runoff onto public highway
