The proposal involves extending an existing agricultural building, which measures 12.2m wide, 18.4m long and 5.2m to the ridge, by adding a front extension of 9.1m x 27.5m with a ridge height of 6.3m and eaves at 3.6m, finished in Yorkshire boarding and concrete panels, providing 252 sq.m of covered space for increased…

The officer assessed the principle of development under General Policy 3(f) and Environment Policy 15, finding sufficient agricultural need demonstrated by the established 200-acre farm business seeki…
General Policy 3
Presumption against development outside allocated sites except for operations essential for agriculture (f); the extension to provide livestock housing for farm expansion justified the exception as aligned with policy, supporting business growth.
Environment Policy 1
Protection of countryside and ecology; proposal acceptable due to low visual impact from integration into slope and mirroring existing building.
Environment Policy 15
Development of agricultural buildings in countryside requires proven need, sympathetic siting, size, design and materials; agricultural need proven, extension sited adjoining existing building on slope, with matching design/materials to avoid undue landscape harm.
Environment Policy 14
Development should not result in permanent loss of high-quality agricultural land (Class 1/2, 2/3, 3/2); site is Class 3/4 on steep embankment unsuitable for optimal agriculture, so no protected land lost.
General Policy 2
Development control considerations including design and visual impact; proposal's design, finish and siting comply without undue impacts.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Agricultural use only
The extension to the existing agricultural building may only be used for agricultural purposes. Reason: The countryside is protected from development and an exception is being made on the basis of agricultural need only.
Removal if agricultural need ceases
The extension to the agricultural building hereby approved shall be removed and the ground restored to its former condition in the event that it is no longer used or required for agricultural purposes for a period of 24 months. Reason: The extension has been exceptionally approved solely to meet agricultural need and its subsequent retention would result in an unwarranted intrusion in the countryside.
no significant negative impact upon highway safety, network functionality and/or parking as the existing access design is acceptable for the increase in operations
Highway Services HDC does not oppose the application due to no significant negative highway impacts, while Malew Parish Commissioners object due to lack of agricultural justification.
Key concern: no agricultural justification for the proposed development
Highway Services HDC
No ObjectionAfter reviewing this Application, Highway Services HDC finds it to have no significant negative impact upon highway safety, network functionality and/or parking as the existing access design is acceptable for the increase in operations that the proposed extension will bring, and will allow further agricultural activities to remain on the land rather than travelling to other sites to store animals, materials and machinery etc. as needed.
Malew Parish Commissioners
ObjectionThe Commissioners discussed the above planning applications at their meeting held on 7th August 2024 and resolved that they object to the proposal as their appears to be no agricultural justification for the proposed development.
