Officer’s Report
1.0 THE SITE 1.1 The site is 5 Greeba Avenue, Glen Vine, a detached dwelling located on the west of Greeba Avenue. The property has a hipped roof and there is a conservatory at the side/ rear of the house.
1.2 The street scene is of varied character made up of single storey bungalows, with a variety of roof designs with pitched, hipped, dual pitched roofs present. In addition whilst a number of properties have chimneys there are some present which do not in the near vicinity.
2.0 THE PROPOSAL 2.1 The proposed is the removal of chimney stacks, internal alterations and removal of one window.
2.2 The window to be removed is in the rear elevation and is vertically orientated in design amongst two other habitable windows.
3.0 PLANNING HISTORY 3.1 Replacement of existing glazed conservatory roof with a new pitched roof with light weight roof tiles was APPROVED under 15/00087/B.
4.0 PLANNING POLICY Site Specific 4.1 The site lies within an area designated on the Area Plan for the East as Residential and is not within a Conservation Area or area of flood risk.
Strategic Policy 4.2 The Isle of Man Strategic Plan 2016 contains the following policies that are considered materially relevant to the assessment of this current planning application: General Policy 2 states: "Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality; h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; i) does not have an adverse effect on road safety or traffic flows on the local highways."
5.0 OTHER MATERIAL CONSIDERATIONS Strategy and Guidance 5.1 The Residential Design Guide (July 2021) contains the following guidance that are considered materially relevant to the assessment of this current planning application: o Chapter 5 Architectural Details o Chapter 7 Impact on Neighbouring Properties
6.0 REPRESENTATIONS 6.1 Michael Commissioners has no not commented at the time of the report (02.07.2024).
6.2 DoI Highway Services states there is no highway interest in this application (31.05.2024).

7.0 ASSESSMENT
7.1 The key considerations of this application are its impact on the character and street scene of the area, and the amenities of the neighbours. Character and Street scene
7.2 The area is made up of a variety of roof designs and as stated there are some properties that do not have chimneys present. Additionally permission was given at No 9 Greeba Avenue fro the removal of a chimney under application 24/00338/B. As such the removal of chimneys is not considered harmful to the character of the area or street scene. Additionally the internal alterations and removal of the rear window are not considered to have any significant detrimental impact on the street scene.
Neighbouring Amenities 7.3 The proposals seek to remove chimneys which are not considered to impact on residential amenity. Additionally the removal of the rear window and internal alterations are not considered to have any significant detrimental impact on amenity.
8.0 CONCLUSION 8.1 Overall, it is considered that the proposals would have no adverse impact upon on the character of the house and the area and on neighbouring amenities and therefore comply with the relevant policies in the Strategic Plan.
9.0 INTEREST PERSON STATUS 9.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land which the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
9.2 The decision-maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
