The officer concluded the proposal has an acceptable visual impact on the streetscape, Conservation Area, and setting of Castle Rushen, despite subjective views on the artwork, as it complies with S16…
General Policy 2
Requires general standards for acceptable development including visual amenity (b,c,g), public safety, highway safety (h,i), and amenity (m). Officer found proposal compliant as it has acceptable visual impact, no highway harm, and is structurally sound.
General Policy 3
Exceptions to countryside development include (h) works for interpretation of wildlife. Sculpture interprets local heron wildlife in harbour setting, justifying principle despite undesignated land.
General Policy 9
Promotes inclusion of public art. Proposal as public sculpture on art trail serves public enjoyment and reflects local character.
Strategic Policy 4
Development must protect or enhance setting of Conservation Areas and Registered Buildings like Castle Rushen. Assessed as not harming setting or views due to backdrop of buildings and existing vertical elements.
Environment Policy 35
Protection/enhancement of Conservation Areas. No adverse harm to character; steel finish in-keeping with harbour materials.
Environment Policy 36
Views into/out of Conservation Areas. Slender form does not detract from Castle views; fits with yacht masts and streetscape.
Environment Policy 42
Settlement character and locality. Compatible with harbour's industrial palette and verticality.
Environment Policy 1
Protection of countryside outside settlements. Not undermined as site is central, urban-edged, and art promotes wildlife interpretation.
Environment Policy 4
Protection of habitats. No impact on habitats as sited on existing platform out of water.
Environment Policy 7
Protection of watercourses. No change to watercourse or flood risk.
Environment Policy 13
Flood risk. Elevated design allows water flow; no worsening of existing high-risk area.
Landscape Proposal 4
Development adjoining approach routes to Castletown sympathetic to historic centre and safeguarding Castle views. Material and siting acceptable.
Landscape Proposal 5
Impact on views of/from Castle. Does not harm roofscapes or prominence.
Landscape Proposal 6
Siting of tall vertical elements not affecting setting of Castle. Slender proportions acceptable amid harbour verticals.
Transport Policy 13
Development not compromising harbour users or historic character. No overhang beyond platform.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Do not oppose - no significant negative impact upon highway safety, network functionality and/or parking
no objection
Highway Services, DOI Flood Risk Management, and DEFA Inland Fisheries raised no objections to application 24/00412/B for a heron sculpture on the former swing bridge platform in Castletown, with Highways providing advisory comments on wind resistance.
Highway Services HDC
No ObjectionAfter reviewing this Application, Highway Services HDC finds it to have no significant negative impact upon highway safety, network functionality and/or parking, as the position of the heron sculpture will not hamper the visibility splay at the Back Hope Street/Castle Street junction for a 20mph speed limit road on Castle Street.; It is advised that the applicant confirms to the planning department that the sculpture can withstand extreme winds which can occur in this location so it does not fall onto the highway or harbour in an extreme weather event.
DOI Flood Risk Management
No CommentI had a look at the PA and it poses no flood risk so I have no comment.
DEFA Inland Fisheries
No ObjectionDEFA, fisheries have no objections to this development from a fisheries perspective.
