In this instance of the submitted Condition 9 Agent Statement, dwg RBA_224_(2- )A010_Site Hoarding Layout, dwg RBA_224(2-)_A010_Site Phasing Plan and Condition 9 (phasing) CEMP Appendix III and after consultation with the head of development, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 9 of application 20/01467/B with the understanding that the development shall be carried out in complete accordance with the approved Phasing Plan.

Officer’s Report
1.0 Description
1.1 The proposed application 20/01467/B for the erection of a building to provide exhibition space, retail, apartments and restaurant with associated parking spaces was approved on 28.03.2022 subject to 49 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition 9 which the applicants are seeking to satisfy.
1.3 Specific wording of the condition as follows:

No works in connection with the development hereby approved shall commence unless a Phasing Plan setting out the details of the phasing of the development has been submitted to, and approved in writing by, the Department. The phasing plan shall include but is not limited to making provisions for the following;
The delivery of the commercial elements prior to the occupation of the residential units; o The development to be delivered in each phase; o The timing of each phase; o The sequence of the development; o How earlier phases will be able to operate satisfactorily while later phases are still under construction.
Thereafter, the development shall be carried out in complete accordance with the approved Phasing Plan.
Reason: To ensure that build-out of the development is phased so as to avoid adverse impact on local services and infrastructure and in the interests of the visual amenity of the area and to make sure that the development is carried out in full and the commercial elements are provided as per the approval as the development has been assessed on a mixed use provision and to comply with the Development Brief 22 of the Area Plan for the South (2013)."
2.0 Proposal
2.1 The applicant's agent have now submitted Condition 9 Agent Statement, dwg RBA_224_(2-)A010_Site Hoarding Layout, dwg RBA_224(2-)_A010_Site Phasing Plan and Condition 9 (phasing) CEMP Appendix III. These documents cover the phasing for the development including the development to be delivered in each phase, the timings, the order and how earlier phases will be able to operate while work continues.
3.0 Recommendation
3.1 In this instance of the submitted Condition 9 Agent Statement, dwg RBA_224_(2- )A010_Site Hoarding Layout, dwg RBA_224(2-)_A010_Site Phasing Plan and Condition 9 (phasing) CEMP Appendix III and after consultation with the head of development, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 9 of application 20/01467/B with the understanding that the development shall be carried out in complete accordance with the approved Phasing Plan. __
I can confirm that this decision has been made by the Director of Planning and Building Control in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
