Officer’s Report
1.0 THE SITE
1.1 The site is located within the recently approved access serving a parcel of land which sits on the southern side of the Barregarrow crossroads which links the Sartfell/Beinn y Phott Roads with the A3 TT course, and is associated with the residential curtilage of an existing

dwelling 'Rose Cottage' which is served by a detached garage as well as a larger open area to the south.
1.2 The access is laid to hardstanding and is enclosed by timber fencing approximately 2.0m in height. The application site sit immediately against the fencing and is set within the access and away from the A3 frontage.
2.0 THE PROPOSAL
2.1 The application seeks consent for the display of an illuminated business sign associated to the recently permitted kennels and dog exercise area at Rose Cottage.
2.2 The sign will have a fascia measuring 1000mm x 800mm and it will be fixed to 2 no. timber posts 1300mm in height. The bottom edge of the sign will be 300mm above ground level.
2.3 The sign will be of an acrylic fascia with matt finish and black lettering. It will be illuminated by LED lighting strips within PPC aluminium housing.
3.0 PLANNING POLICY
3.1 The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as not for a particular purpose and also within areas of Woodland and High Landscape or Coastal Value and Scenic Significance.
3.2 Due to the designation of the site and the nature of the application it is appropriate to consider the following polices of the Isle of Man Strategic Plan 2016:
3.3 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality;
3.4 General Policy 8: "Within rural areas the display of external advertisements will be permitted only where: (a) they are located on or directly next to the premises to which they relate; (b) they do not detract from the appearance of either the immediate area or the landscape; (c) they are normally constructed of traditional materials unless the nature of the display or location would render such materials inappropriate; (d) any illumination, which will be permitted only where it is essential, is kept to a minimum and is so hooded as to prevent undesirable escape of light; (e) they are located so as not to cause a highway safety hazard; and (f) any illumination will not have an adverse effect on areas of ecological value. i) the proposal preserves or enhances the Conservation Area; ii) the signage is in a style appropriate to the character of the area; iii) traditional materials and finishes are used and glossy and highly reflective materials are excluded from proposals; and iv) internally illuminated box fascia and projecting box signs are excluded from the proposals'."
3.5 It must be noted at the time of writing, the Draft Area Plan for the North and West is not formally adopted and is only, at this stage, a broad direction of how planning policy is reviewing the areas. Their proposals can still be challenged at a public enquiry where an inspector could reach a different opinion to the drafts. The final draft would also need to be

ratified by COMIN. This means that the 1982 development plan remains the correct land use designation, and no material weight is given to the Draft Area Plan for the North and West.
4.0 OTHER MATERIAL CONSIDERATIONS
4.1 The Control of Advertisements Regulations 2013 make it clear that the only considerations which can be applied to applications made under them are in the interests of amenity and public safety. In the case of amenity, such things as the general characteristics of the area need to be taken into account along with the presence of any features of historic, architectural, cultural or similar interest and the public safety should consider the safety of any person using a road, railway, tramway, harbour or aerodrome including the obscuration of any traffic sign or similar.
5.0 PLANNING HISTORY
5.1 The following application is of material relevance to the proposal:
24/00397/B - Conversion of existing garage to kennels and change of use of part field for dog exercise. Permitted 16/4/2025
6.0 REPRESENTATIONS
6.1 The following Statutory Consultees have been consulted and their responses can be summarised as follows:
Michael Parish Commissioners - No comments received. DOI Highway Services - No Highways Interest.
6.2 No representations have been received from members of the public.
7.0 ASSESSMENT
7.1 The proposed signage will advertise the business operations at Rose Cottage that were recently approved under application 24/00397/B. The advert is located on the business premises as is required by general Policy 8.
7.2 The proposed sign will be set well back from the highway and within the site where it will stand against existing timber fencing which will provide a suitable backdrop. The fascia will not be of a traditional material (i.e. timber) but instead acrylic, which this is not strictly in accordance with General Policy 8, the proposed matt finish to the fascia is considered appropriate.
7.3 The site is within the countryside and it is noted that a low degree of illumination is proposed, with vertical LED strips either side of the fascia. To aid legibility for customers to the site, it is accepted that a low degree of illumination is needed for the sign which would otherwise not be visible at the entrance to the business site at times of darkness.
7.4 Illumination would usually be inappropriate in a rural setting but having regard to the discreet siting of the sign and its setting against a large amount of timber fencing, the illumination will not be visible from outside of the site except for at the entrance. The impact upon the character and appearance of the landscape and biodiversity will therefore be very limited.
7.4 The siting of the signage, away from the public highway and within the site, will ensure that it does not act as a distraction to drivers when approaching or passing the site.

8.0 CONCLUSION
8.1 The proposed business signage is considered to be of a suitable scale, design and finished appearance. The low level of illumination proposed and siting within the site and away from the highway results in there being no significant adverse impact upon the character and appearance of the area, biodiversity, highway safety or other matters of material planning relevance.
8.2 The proposal is considered to comply with General Policies 2 and 8 of the Strategic Plan and it is therefore recommended that the application be approved.
9.0 INTERESTED PERSON STATUS
9.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Persons to whom notice has been given under regulation 10(3)(a)(i) (d) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; (e) The Highways Division of the Department of Infrastructure; (f) The Ports Division of the Department of Infrastructure; (g) The operator of the railway or tramway; and (h) The local authority in whose district the land the subject of the application is situated.
9.2 The decision maker must determine: o whether any other comments from Government Departments (other than those explicitly listed above) are material; and o whether there are other persons to those listed above who should be given Interested Person Status.
