Officer’s Report
THE APPLICATION SITE
1.1 The application site is the residential curtilage of "Hill View," Ocean Castle Drive, Promenade, Port Erin, which is a modern detached bungalow with integral garage situated to the Northern side of Ocean Castle Drive.
THE PROPOSAL
2.1 The current planning application seeks approval to replace the existing garage door within the front elevation with windows/doors which will sit within the same aperture and to replace an existing window situated to the living room (South West elevation) of the property with glazed doors.
PLANNING HISTORY
3.1 There are several applications upon the site, with one pending, of which the historic and pending application will not be impacted by the proposal within this application.
PLANNING POLICY
4.1 The dwelling sits within an area zoned as Predominantly Residential on the Area Plan for the South, Map 7 - Port Erin/Port St Mary. The site is not within a Conservation Area, nor a Flood Risk Zone.
4.2 Given the nature of the residential property and the land designation paragraph 8.12.1 and General Policy 2 from the Isle of Man Strategic Plan 2016 are most relevant to its assessment which set out the general standards towards acceptable development.
4.3 The recently released Residential Design Guidance 2021 is also a material consideration particularly those parts in respect of good neighbourliness and overlooking.
4.4 Furthermore consideration shall also be given to Community Policies 7 and 11 in respect of reducing outbreak of fire and preventing criminal activity and Infrastructure Policy 5 in respect of water conservation.
REPRESENTATIONS

5.3 Port Erin Commissioners have considered the application and state, "they have resolved to support the application." (15.05.24)
ASSESSMENT
6.1 Paragraph 8.12.1 of the Isle of Man Strategic Plan 2016 states that there is a general presumption in favour of extensions or alterations to existing properties where such works would not have an adverse impact on adjacent properties or the surrounding area in general.

6.2 In the case of this application, the proposed works encompass two parts of the site, firstly the replacement of a garage door and then the replacement of a window with doors to the existing living room. Both are situated to the front elevation of the property.
6.3 The proposal to change a window into sliding doors to the Living Room is an acceptable alteration and should not impact any neighbouring amenity or how the property is viewed within the streetscene.
6.4 With regards to the proposed alteration to the garage door there is potential that this could mean the removal of car parking spaces, which would mean that the property would not comply with Transport Policy 7 in connection with Appendix 7. The site has the advantage of a large parking apron to the front of the property which could hold 3/4 cars, as such the proposal would comply with the recommended 2 spaces per property. The proposal works will also not impact the overall character and appearance of the property within the streetscene and as such deemed acceptable.
CONCLUSION
7.1 For the above reasons the proposed the proposal is considered to comply with General Policy 2 and Transport Policy 7 of the Isle of Man Strategic Plan 2016 and therefore acceptable.
INTERESTED PERSON STATUS
8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 (Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status. __
I can confirm that this decision has been made by the Director of Planning and Building Control in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
